September 2019 MCLE Luncheon with Neil D. Kalin

Our next lunchtime MCLE program will be Thursday, September 12, 2019 at 12:00 pm, at the Manhattan of La Jolla restaurant (7766 Fay Avenue). We are pleased to welcome Neil D. Kalin, Assistant General Counsel to California Association of Realtors (C.A.R.) 

Mr. Kalin will be giving a presentation in the subject area of Standard forms mistakes lawyers make AND key differences between C.A.R. and AIR commercial contracts AND … More! Comparison and Contrasts between standardized contractual forms used for residential real estate transactions, and those used for commercial real estate transactions.

The program will include discussion of several topics, including:

Mistakes – that lawyers make relative to standard real estate forms, such as:  forgetting to mediate before litigating or arbitrating;  mistaking the form to be more important than the substance;  failing to read the contract or disclosure forms;  believing/assuming that the broker is always wrong.

AIR CRE and CAR forms – Passive versus Active Contingency Removal;  Absolute versus good faith contingency removal;  Mandatory mediation versus no litigation prerequisite;  Contract strike-throughs versus changes made by addendum or amendment.

Real Property Law Section Opportunities – upcoming events and Executive Committee vacancies

All attorneys at some point in their professional or personal lives will likely have situations involving use of California Association of Realtors forms relative to purchase/sale of residential property, and/or, involving use of AIR CRE (formerly known as the AIR Commercial Real Estate Association) for commercial real estate purchase/sale transactions.  

Mr. Kalin will discuss these forms as well as other related information during his presentation.

The program is currently evaluated as providing 1.0 hr general CLE credit.

Some information about our Speaker:

Neil D. Kalin  joined the California Association of REALTORS® in 1987 and is now Assistant General Counsel.  He is the senior legal advisor to C.A.R.’s Standard Forms Committee, provides advice to C.A.R. members on the Legal Hotline, and writes many of C.A.R.’s Appellate Court Briefs.  Neil is an arbitrator for the American Arbitration Association (AAA) and has served as a Judge Pro Tem and a volunteer mediator and arbitrator for the Los Angeles County Superior Court.

Neil has earned his CIPS designation (Certified International Property Specialist) from N.A.R. in 2001.  In 1982, Neil received his Bachelor of Science degree in Advertising from the University of Illinois.  Also in 1982, he received his Certificate of Public Accountancy (CPA).  Neil was graduated from UCLA School of Law in 1985.
