Hattam\, General Counsel for the San Diego County Water Authority\, as our speaker for this event. Mr. Hattam will present “Update on San Diego County Water Authority Water Rate Litigation” \n  \nInformation about our speaker: \nMark J. Hattam is General Counsel for the San Diego County Water Authority. \nAs General Counsel\, Mr. Hattam advises the Water Authority’s Board and executive staff on a wide range of legal matters\, including the agency’s high-profile litigation over the legality of rates set by the Metropolitan Water District of Southern California. The Water Authority is the San Diego region’s wholesale water supplier\, providing imported supplies and desalinated seawater to 24 member agencies that serve 3.3 million residents and support a $222 billion economy\, with a focus on securing a safe and reliable water supply for the San Diego region. \nPrior to joining the Water Authority as General Counsel in 2016\,   Mr. Hattam was a 22 year member and partner in the San Diego office of Allen Matkins Leck Gamble Mallory & Natsis\, a California-based law firm with approximately 200 attorneys specializing in real estate\, litigation\, labor\, tax\, land use and business law.   His practice at Allen Matkins involved litigation in state and federal courts regarding water rights\, commercial disputes\, real property\, insurance\, environmental regulations and other issues\, as well as administrative hearing practice. \nMr. Hattam has represented major institutional and public-sector clients in complex civil litigation\, including water transfers and water rates.   He represented the Imperial Irrigation District as trial counsel in 2013\, securing validation of the historic 2003 Colorado River Quantification Settlement Agreement\, a cornerstone of the Water Authority’s long-term water supply diversification strategy.\nIn 2015\, Mr. Hattam served as outside counsel for the Water Authority\, successfully defending the agency against  claim that it failed to account for the environmental impacts of its long-term water supply plan. His extensive knowledge of the intricate legal issues regarding water supplies\, transfers and rates in California\, combined with his demonstrated expertise at both trial court and the appellate court levels were cited by the Water Authority’s Board as important considerations in his engagement as the Authority’s General Counsel. \nMr. Hattam is a graduate of  Loyola Law School\, Loyola Marymount University (Juris Doctorate – 1994)\, where he received  Order of the Coif\, and Dean’s Scholar honors.

DESCRIPTION:Summer Beach Party\nFriday\, August 3\, 2018 at 4:30 pm\nLa Jolla Beach & Tennis Club\n  \nLa Jolla Bar Association Members & Guests: \nAgain this year\, our LJBA summer party will be a beach barbeque picnic at the La Jolla Beach and Tennis Club** on Friday\, August 3\, 2018\, beginning at 4:30 p.m. \nWe will congregate at the far north end of the beach in front of the Club\, in the section marked “W\,” “X\,” “Y\,” or “Z.” Tables will be set up and our location will be marked with a table sign. LJBA will provide soft drinks\, wine\, beer\, ice\, hors d’oeuvres\, side dishes and dessert for all; and tables\, chairs\, charcoal\, barbeques\, etc. \nYOU are requested to bring a main course for you and your guests and children–meat\, fish or whatever entree you wish to barbeque; AND warm clothes for socializing after sunset and when the weather has a habit of turning chilly and/or damp at the beach. \nAttendance is limited to two adults per member (i.e.\,the member and one significant other); children and grandchildren of the member; and guests invited by the member. S. patent agent with over 30 years of technical experience in hardware and software.  \nMr. Mayo graduated from the Massachusetts Institute of Technology  (MIT) in 1983 with a degree in Electrical Engineering.   His experience includes: strategic patent portfolio development; patent prosecution; post grant review proceedings; litigation support; and representation of both US and international companies\, ranging from large corporations to start-ups\, and individual inventors.  \nMr. Mayo’s extensive experience in computer systems\, hardware\, software\, medical devices\, and mechanical devices has resulted in more than 600 patents being issued by the USPTO and abroad. A clear understanding of the California transfer tax framework is required to avoid unnecessary confusion\, delay\, and expense in California real property transfers involving family members\, trusts\, and entities and Mr. Lautanen is a recognized expert in this area. \nAlan Lautanen\, Esq.’s Biography \nW. Alan Lautanen is a partner in the Tax Controversies and Planning Group at Henderson\, Caverly\, Pum & Charney LLP. Mr. Lautanen represents the Firm’s clients in federal\, California\, and local tax controversies and tax planning. \nMr. Lautanen is widely known for his property tax expertise\, having represented publicly held and other companies in the health care\, life sciences\, energy\, airline\, medical research\, communication\, entertainment\, manufacturing and real estate industries in their California property tax matters. Mr. Lautanen has represented clients in administrative property tax appeals and property tax litigation in San Diego\, Los Angeles\, Orange\, Kern\, Riverside\, San Bernardino\, Santa Clara and numerous other California counties. He has extensive knowledge of the appeal procedures in place throughout California. \nMr. Lautanen also has substantial experience in corporate and partnership restructuring\, business sales\, and real estate matters. \nMr. Lautanen earned a bachelor’s degree from Kent State University in 1975 and his law degree from Duke University in 1980. While at Duke\, he served on the Editorial Board of the Duke Law Journal. Prior to practicing law\, Mr. Lautanen practiced as a Certified Public Accountant with the Haskins & Sells “Big 8” public accounting firm. \nMr. Lautanen served as an adjunct professor at California Western School of Law and has spoken and written extensively on various tax issues. Mr. Lautanen is admitted to the United States Tax Court and the United States Claims Court\, the United States District Court for the Southern District of California. DESCRIPTION:Our next MCLE  lunchtime program will be Thursday\, March 9th\, at noon\, at the Manhattan of La Jolla restaurant (inside the Empress Hotel\, 7766 Fay Avenue). \nWe are very pleased that our March speaker will be Summer Stephan\, Chief Deputy District Attorney for San Diego County. Ms. Stephan will present a program entitled\, “The Laws and Challenges of Human Trafficking – San Diego’s Combat Plan”.   \nThis program will provide 1.0 hour continuing education credit for the California State Bar and 1.0 hour in required subject area of “Recognition and Elimination of Bias in the Legal Profession and Society.” \nSome information about our speaker: \nSummer Stephan has served San Diego County as a Deputy District Attorney for 27 years\, and has tried more than 100 jury trials\, including special circumstance homicides\, sexually violent predators\, child molestation\, sexual assault\, child abuse\, school shooting\, assault on peace officers\, and human trafficking-related cases. \nDuring her career as a prosecutor\, Ms. Stephan has received numerous appointments\, awards and commendations\, including among them: \n\nAppointment to Chief of the District Attorney’s Office North County Branch;\nAppointment to Chief of the Sex Crimes and Human Trafficking Division;\nAppointment to Chief Deputy District Attorney for San Diego County (2012 to present);\nRecipient of FBI commendation for organized crime prosecution;\nRecipient D.A. Brooks\, Executive Director\, Institute for Criminal Defense Advocacy; Professor of Law at California Western School of Law for its LL.M. in Trial Advocacy program; and Director\, California Innocence Project. \nProfessor Brooks’ presentation will be CAUSES OF WRONGFUL CONVICTION AND THE SUCCESSES OF THE CALIFORNIA INNOCENCE PROJECT.  \nThis will be an interesting\, informative and insightful program that you will not want to miss\, regardless of your practice area. Please ensure that you have this on calendar for this coming Thursday! \nFurther information about our speaker:\nJustin Brooks is the Director and Co-Founder of the California Innocence Project. Prior to coming to California\, he practiced as a criminal defense attorney in Washington D.C.\, Michigan\, and Illinois and over the course of his career he has served as counsel on several high profile criminal cases. He has been recognized several times by the Los Angeles Daily Journal as one of the Top 100 Lawyers in California. In 2010 and 2012\, California Lawyer Magazine recognized him with the “Lawyer of the Year” award. Justin began his teaching career as a Fellow at Georgetown Law Center in 1990. He continued to teach at Georgetown after his fellowship ended and served as Associate Director of Georgetown’s Corrections Clinic. In 1993\, he began teaching at Thomas M. Cooley Law School where he taught criminal law\, criminal procedure\, death penalty law\, and law and literature. He directed the moot court program\, coached the law school’s first National Championship moot court team\, and supervised a death penalty clinical program. Justin has worked extensively in Latin America training lawyers for the past 20 years.  Justin co-founded Red Inocente\, an organization devoted to founding and supporting innocence organizations in Latin American\, including: the Puerto Rico Innocence Project\, Mexico Innocence Project\, Chilean Innocence Project\, Colombian Innocence Project\, and Argentinian Innocence Project. Justin is a tenured professor at California Western School of Law. DESCRIPTION:Our next LJBA lunchtime MCLE program will be Thursday\, November 10th at 12:00 noon\, at the Manhattan of La Jolla restaurant (within the Empress Hotel @ 7766 Fay Avenue). \nWe are pleased to have the Honorable Peter C. Deddeh\, Judge of the Superior Court for San Diego County\, as our speaker this month\, who will present an  “Overview of the Superior Court’s Transition into the New Courthouse.” \nJudge Deddeh’s presentation will cover a multitude of issues\, past\, present and future\, which will impact the San Diego Superior Court’s civil and criminal case administration\, personnel\, and operations\, which issues are of great importance to attorneys and the public.  The presentation will address steps that have been taken by the court to achieve more cost-effective and efficient operations as it transitions to the new downtown courthouse\, including discussion of the court’s efforts and success in reducing the civil case backlog over the past three years\, and the steps taken to improve the court’s Case Management System\, particularly in the areas of electronic filing\, appeals processing\, and staff training on Unlawful Detainer procedures and processes. This will surely be an interesting and informative presentation. \nJudge Deddeh’s presentation will provide 1.0 hour of MCLE credit.\nClick here to view the written material for the presentation. \nSome information about our speaker: \nJudge Peter C. Deddeh was appointed to the San Diego County Superior Court in June 1998 by Governor Pete Wilson and was re-elected 2012. He currently serves as Assistant Presiding Judge of the Court’s Central Division through 2017 and will serve as its Presiding Judge for 2018 and 2019. He previously was  Supervising Judge of the Court’s East County Division (2007-2011); Presiding Judge of the Court’s Appellate Panel (2007); and Criminal Presiding Judge for the Court’s San Diego (2001-2005) and Vista (1998-2000) divisions.   Judge Deddeh has also served on the California Judges Association Board of Directors (2007-2010). \nPrior to joining the Superior Court bench\, Judge Deddeh was a DDA with the San Diego County District Attorney’s Office (1983-1998)\, during which time he prosecuted numerous felony and  misdemeanor cases\, with a large number being violent street gang offenses\, of which 15 were gang murder jury trials. \nIn addition to his work at the Courthouse\, Judge Deddeh presides over Homeless Court sessions at St. Vincent De Paul Village and the Vietnam Veterans of San Diego Homeless Shelter. \nJudge Deddeh is a graduate of the University of California\, Santa Barbara (BA\, History/Political Science\, 1978)\, and of the University of San Diego School of Law (JD\, 1982). \n

Lincoln\, speaking to us on “The San Luis Rey Indian Water Dispute and Settlement\,” a presentation which will address the rich and involved history of this complicated local water rights dispute\, which has been at play since 1875 when the United States set aside reservations for local Indian tribes with rights to the San Luis Rey River waters\, and north county cities and county areas began diverting that water to their own purposes. \nDon’s presentation will address the governmental actions\, state and federal laws\, and the multiple litigations during the history of this dispute\, including the difficulties involved in bringing to conclusion a settlement of the dispute. Tax\, 1989).   Experienced in many areas of civil law\, Don’s primary practice has been representing municipal agencies as special counsel in complex administrative\, trial and appellate proceedings.  He has also participated in the drafting of local\, state and federal legislation. \nDon has been counsel of record in more than thirty reported appellate cases\, including successfully representing the City of  Escondido before the United States Supreme Court in two cases\, one involving a water and power dispute against five Indian Bands (Escondido Mutual Water Company\, et al.\, v. La Jolla Band of Mission Indians\, et al.\, 466 U.S. 765 (1984)\, and the second upholding a city’s right to enact mobilehome park space rent control (Yee v. City of Escondido\, 503 U.S. 519 (1992)). \nSome of Don’s other appellate work include representing fifty-two California counties in a property tax case before the Ninth Circuit (Marvin Poer and Company v. County of Alameda\, et al.\, 725 F. 2d 1234 (9th Cir. 1984)\, and presenting oral argument as Amicus Curiae on behalf of seventy-six cities in a mobilehome park rent control case before the California Supreme Court (Galland v. Paul will present “INITIATING AND DEFENDING DRIVERS LICENSE SUSPENSIONS\,” to include: \n–  the varying circumstances and triggering events for the DMV to initiate proceedings to suspend or revoke a driver’s license;   \n– what takes place at a DMV suspension/revocation hearing and the rules and evidence standards  involved during such hearings (and how these rules and standards differ from those of a courtroom); \n– the multiple factors  involved in determining duration of a license suspension by the DMV and how a DMV suspension interplays with a Court imposed license suspension; and  \n– use of administrative writs to challenge DMV suspension or revocation of a driver’s license.   \nSome information about our speaker\, Paul Neuharth: \nPaul is a criminal defense attorney who represents clients in both State and Federal courts for matters ranging from misdemeanor to the most serious felonies.  He is recognized for his knowledge\, experience and skills at providing an aggressive and focused defense to his clients.  \nPaul is recognized as being among the top 0.1% of all attorneys in the state at successfully defending clients at DMV hearings.  He has a success rate exceeding  90%  for writs that he has filed\, either through stipulation or contested hearing.  \nWe hope to see you next week at this lunchtime MCLE event.

Eyherabide\, Judge of the Superior Court\, who will be speaking on “The Evolution of Sentencing in California Courts” and recent legislative changes in the laws relative to sentencing\, its focus and purpose. \nJudge Eyherabide was appointed to the San Diego Superior Court in 2006. At time of her appointment\, Judge Eyherabide was a prosecutor of eleven years with the San Diego County District Attorney’s Office. Previously\, she had been an Assistant U.S. Attorney in Washington\, D.C. from 1992 to 1995. At the San Diego District Attorney’s Office\, Judge Eyherabide was in charge of its nationally respected Family Protection Unit\, which was featured in the documentary criminal justice television 13-part series ”Crime & Punishment” in 2002. \nJudge Eyherabide’s presentation will provide 1.00 hour of CLE credit.

DESCRIPTION:Reminder of the LJBA’s lunch meeting on Thursday\, March 10th at 12:00 noon\, at the Manhattan of La Jolla restaurant\, located within the Empress Hotel\, 7766 Fay Avenue (at Fay & Silverado). \nOur speaker for March is Michael Wakshull\, who will be presenting “Will Bias Cost You Your Next Case?” in which he will address the various types of biases that are at play in the courtroom during trial and other proceedings.  Mr. Wakshull will provide an overview of these various forms of bias\, to include actual bias; implied bias; judicial bias; advocate’s bias; witness motivational bias; and cognitive and contextual biases. The program will also include discussion of how biases in forensics influence expert witness testimony\, and in turn influence the judge or jury hearing such testimony. \nMr. Wakshull’s presentation is structured to provide 1.00 Hours of CLE credit in the area of “Bias”\, as required by the California State Bar.  His presentation has been approved by the California State Bar. \nWe hope that you will be able to attend this program on March 10th. \nAbout Our Speaker: \nMichael Wakshull has studied the science and discipline of document examination and handwriting analysis for 30 years. He has been qualified as an expert witness in state and federal trial courts throughout California\, testifying in cases involving will contests\, contract disputes\, altered deeds and mortgage documents\, altered handwritten documents\, electronic documents and other types of questioned documents\, and he has served as an expert in forensic document examination cases throughout thirteen states. \nHe has authored two books on the topic of forensic document examination\, and has given presentations at several  forensics conferences\, including the National Association of Document Examiners (NADE) annual conference; the Association of Forensic Document Examiners (AFDE); the World Congress of Forensics in Chongqing\, China; and the National Institute of Standards and Technology (NIST).    He has chaired  the National Association of Document Examiners 2012 conference\,  the Scientific Association of Forensic Examiners 2014 Conference\, and the Forensic Expert Witness Association 2015 conference.  \nMr. Wakshull’s interest in the role of bias and its impact on dynamics of human interaction is lifelong\, starting when he was a graduate student and continuing over the years in his career as questioned documents examiner and handwriting analyst.

Sloan\,  as its lunchtime MCLE speaker\, to speak on Trade Secret Law. Topics will include its history; California and Federal statutory authorities; significant reported decisions; discussion of what constitutes protectable information and what constitutes misappropriation of trade secrets/confidential information; legal theories applicable to misappropriation avoidance; and suggestions for prevention of economic espionage. \nProfessor Sloan\, a trial attorney for 44 years\, has also been adjunct professor of law at the University of Virginia School of Law the past 11 years\, teaching the law school’s accelerated course in Trade Secret Law. Professor Sloan also taught courses for several years in Trial Practice and Conflicts of Laws at Pepperdine University School of Law. \nProfessor Sloan frequently presents continuing education programs on Trade Secret law\, as well as the Mexican legal system and coastal permitting and litigation. He has authored articles on trade secret theory and litigation\, and authored a monograph on defense of trade secret litigation\, published by the American Bar Association section on Patent\, Trademark and Copyright. \nSpecial thanks to LJBA member Roy Morrow Bell  for his assistance in obtaining Todd M. Hoffman\, Hoffman & Associates\, who will speak to us on “Detection and Prevention of Substance Abuse in the Legal Profession.” \nMr. Hoffman’s presentation will focus on substance abuse and related issues which affect a significant number of professionals in the legal community\, and will raise awareness in identifying behavior which crosses the line between proper and problematic uses of alcohol\, drugs and prescription medications. \nTopics to be discussed will include common lifestyle factors which contribute to substance abuse\, including work related stress\, family issues\, and certain psychological conditions. Mr. Hoffman will highlight how to spot the initial warning signs and behavioral symptoms\, and he will address various other forms of addiction\, including medical marijuana\, gambling\, and food addictions. \nMr. Hoffman will also address situations of inappropriate or unethical conduct linked to substance abuse and addiction problems\, and the serious consequences of attorney substance abuse in relation to potential State Bar sanctions and/or criminal convictions. His presentation will examine different treatment options to address the varying degrees of substance abuse\, including Alcoholics Anonymous\, psychological counseling and drug treatment programs. \nMr. Hoffman has been a criminal defense attorney in California for nearly 40 years\, representing clients in defense of DUI and other misdemeanor and felony cases.
