She has obtained defense verdicts in cases involving catastrophic injuries\, including quadriplegia\, traumatic brain injury\, and wrongful death. She is a member of the American Board of Trial Advocates (ABOTA) and is board-certified in Medical Malpractice by the American Board of Professional Liability Attorneys (ABPLA). Tricia is board-certified as a Civil Trial Specialist and Civil Practice Advocate by the National Board of Trial Advocacy (NBTA). DESCRIPTION:Our association’s summer beach party and picnic will be held at: \nLa Jolla Beach and Tennis Club\nFriday\, August 13\, 2021\nbeginning at 4:00 p.m.\nTables will be set up and our location will be marked with a table sign. \nAs a convenience to our attendees this year\, the LJBA is providing Mexican cuisine\, as well as soft drinks\, wine\, beer\, ice\, side dishes\, and desserts for the group. Tables and chairs will be provided\, along with charcoal and barbecue grills for those wishing to bring their own meat\, fish or other entree to barbecue. \nCOME EARLY AND STAY LATE – you are welcome to arrive earlier in the day and use the Beach Club facility if you like. She is a member of the Real Property Law Section Executive Committee\, and was elected Chair of the Real Property Law Section during 2015.  \nMrs. Welsh-Levin is a California licensed real estate broker and an active member of the San Diego Association of REALTORS®.  She has served on committees at SDAR\, and attended legislative functions as a representative of the association.  She is also a member of the California Association of REALTORS®\, and the National Association of REALTORS®.   \nDuring the recession and housing crisis from 2007 through 2014\, Mrs. Welsh-Levin participated in hundreds of HOME Clinics that took place throughout San Diego County\, Imperial County\, and Riverside County. The clinics were sponsored by the U.S. Department of Housing and Urban Development.  As a volunteer attorney at these events\, Ms. Welsh-Levin consulted with homeowners who were in distress because of their mortgages. \nShe was instrumental in passing California’s short sale anti-deficiency statute. Working with Senator Denise Ducheny’s office\, Ms. Welsh helped to introduce Senate Bill 931\, to protect consumers from their lenders when they are unable to pay off the balance of their mortgage loan.  The bill passed and made it mandatory for lenders to forgive the remaining balance of the mortgage debt\, called the deficiency balance\, when the homeowner/borrower completes a short sale of their home.  When the bill went into effect on January 1\, 2011\, it created the California Code of Civil Procedure §580e.   \nMrs. Welsh-Levin counsels attorneys\, real estate professionals\, housing counselors\, negotiators\, and property owners about the law on short sales\, foreclosures\, and loan modifications.     \nAttorney Welsh-Levin opened her law office\, So. Cal. Realty Law\, APC\, in September 2011.  Prior to creating her own law firm\, Ms. Welsh worked for many years at the Law Offices of Michael Spilger\, an exclusive real estate law firm. We are very pleased to have Devin Burstein\, as our speaker for this lunchtime event.  \n  \nDevin Burstein\, partner at Warren & Burstein\, is our speaker for February\, presenting: “A Glimmer of Hope: Federal Compassionate Release and the Pandemic”. \nIn this presentation Mr. Burstein will address the intersection of the pandemic and federal compassionate release\, providing an overview of the process involved in seeking relief; practice tips; and will discuss what is really going on in federal prisons in terms of COVID-19.  \nMr. Burstein has provided our members with excellent past presentations\, and you will not want to miss this topical and interesting program on February 11th. \nPlease mark you calendars for this 1.0 hr MCLE general participatory credit for attendees. \n  \n\nInformation about our Speaker\, Devin Burstein:\nMr. Burstein is the recipient of the San Diego Criminal Defense Bar Association’s award for appellate attorney of the year.  Licensed to practice in both California and New York\, his work focuses on criminal defense\, with a particular emphasis on appellate representation. He also maintains a select\, civil-litigation practice\, and is frequently retained by other attorneys seeking assistance with complex appeals and pre-trial motions.  He has amassed a lengthy record of victories in the trial court and on appeal. \nMr. Burstein graduated with honors from NYU\, where he majored in philosophy. He attended the Benjamin N. Cardozo School of Law\, graduating Order of the Coif (top 10% of his class). He began practicing at the global law firm Proskauer Rose LLP.  \nAt Proskauer\, Mr. Burstein focused on white-collar defense and civil litigation. He helped successfully defend a professional sports franchise owner in a major international arbitration and a boxer against an attempt to seize his position as mandatory challenger for the heavyweight championship of the world. In addition\, Mr. Burstein developed expertise in reinsurance – including representing several executives during corporate and government investigations. He also represented (pro bono) juvenile delinquents in appealing their delinquency adjudications\, and was a core member of the legal team seeking a posthumous presidential pardon for Jack Johnson\, the first African-American Heavyweight Champion. \nMr. Burstein left Proskauer to serve as a judicial clerk for the Honorable Judith S. Kaye\, then Chief Judge of the New York Court of Appeals (New York’s highest court). Viewing cases from the Judge’s perspective\, Mr. Burstein gained invaluable insight into the most effective way to present an argument. He helped draft judicial decisions on a diverse array of criminal and civil issues\, giving him an uncommonly broad range of experience. \nWith California calling\, Mr. Burstein moved from New York to join the nationally renowned Federal Defender office in San Diego. He started as a trial attorney\, representing clients in well over a hundred felony cases. He then transferred to the appellate department\, where he continued defending his clients in the Ninth Circuit Court of Appeals. In addition\, he represented indefinite immigration detainees seeking release from custody\, and assisted inmates challenging their convictions through habeas corpus in federal court. \nMr. Burstein left Federal Defenders to form Warren & Burstein.  The firm began with a simple purpose: to bring dedication\, diligence\, and determination to every case.  Mr. Burstein is firmly committed to that purpose. As a result\, his clients benefit from the highest level of representation.  \nMr. Burstein has been recognized by the Legal Aid Society for outstanding legal services\, and has published numerous articles\, including: \n\nSamuel Seabury\, The Judges of the Court of Appeals (Rosenblatt\, ed.)\, Fordham Univ. Zhang and Steven K. Berenson:\n  \nIrean Zhang is an attorney in the San Diego office of Klinedinst PC. Ms. Zhang’s practice focuses on professional liability defense\, especially in the area of legal malpractice. Prior to joining Klinedinst\, Ms. Zhang practiced business litigation\, with an emphasis in real estate litigation. \nMs. Zhang earned her Juris Doctor degree from the University of San Diego School of Law and her Bachelor of Arts from the University of California\, San Diego. In law school\, Ms. Zhang was the Managing Editor of the San Diego Journal of Climate and Energy Law and represented the University of San Diego in international moot court competitions in Hong Kong and Vienna. Ms. Zhang also externed for the Honorable Barbara L. Major and the Honorable Jill L. Burkhardt of the Southern District of California. \nMs. Zhang is a first generation Chinese-American and is fluent in Mandarin Chinese. She is a member of the State Bar of California\, San Diego County Bar Association\, the Federal Bar Association – San Diego Chapter\, the Lawyers Club of San Diego\, and the American Inns of Court\, Louis M. Welsh Chapter. During her free time\, Ms. Zhang enjoys snowboarding\, Pilates\, and hiking the beautiful Pacific coast with her dogs. \n  \n  \nSteven K. Berenson is a Professional Liability attorney with Klinedinst PC. He has represented individuals and government entities in state and federal courts in a wide range of matters such as legal ethics\, civil litigation\, and family law. \nIn addition to his work in private practice\, Mr. Berenson spent two decades as a full-time law professor\, where he focused on family law\, legal ethics\, and veterans’ legal issues. He founded the Thomas Jefferson Veterans Legal Assistance Clinic\, which today provides pro bono legal representation to homeless veterans struggling with substance abuse issues. A prolific writer\, Mr. Berenson has published a textbook on judicial ethics\, as well as two textbooks on family law. He has also written over 25 law review articles on a wide range of subjects. He regularly speaks on a variety of cutting-edge legal topics within the legal and business communities. \nMr. Berenson previously worked as an Assistant Attorney General in the office of the Massachusetts Attorney General. There\, he focused on civil governmental litigation and consumer protection enforcement. He argued cases at every level of both the state and federal court systems and was a counsel of record in numerous reported decisions including those from the Massachusetts Supreme Judicial Court\, the Massachusetts Appeals Court\, and the United States Court of Appeals for the First Circuit. \nMr. Berenson serves as a Pro Tem Judge in the Small Claims and Traffic Divisions of the San Diego Superior Court. He also serves as a volunteer fee dispute arbitrator for both the San Diego County and California Bar Associations’ voluntary fee dispute arbitration programs.  He is a member of the San Diego County Bar Association’s Legal Ethics Committee. \nHe has received both J.D. (magna cum laude) and LL.M. degrees from Harvard Law School\, and a B.A. degree from Franklin and Marshall College. As someone who loves a challenge\, he enjoys hiking\, biking and running. He has completed more than 20 marathons and half-marathons over the past decade. He is also a drummer in a local band\, The Innocent Bystanders. \n  \n

COTMAN is our speaker\, presenting  “ENHANCING THE WORKPLACE CULTURE\,” in which she will discuss how to recognize and address implicit bias\, and the benefits of diversity\, civility\, and pay equity in the workplace. \nThe program will provide 1.0 hour of MCLE credit for the category: Recognition and Elimination of Bias in the Legal Profession and Society. \n  \nSome information about our Speaker: \nDanna Cotman is a member of our association and a past president (2008).  She is the owner and founder of ARC IP Law\, PC\, a boutique intellectual property law firm located in La Jolla\, California.  Her firm helps their clients add value to their businesses through handling a wide variety of intellectual property matters\, including patent\, trademark\, trade secret and copyright prosecution\, IP litigation\, licensing negotiations\, and enforcement of intellectual property rights for her clients.   She is involved with a number of tech accelerators and works closely with entrepreneurs from early stages of launch through funding and sale. \nDanna is the immediate past President of Lawyers Club of San Diego\, a specialty bar whose mission is to advance the status of women in the law and society.  She holds a J.D. from Thomas Jefferson School of Law\, an MBA from California Coast\, a BSBA from Chapman University\, and an AA in Fashion Design from FIDM.   Danna was recently awarded the Thomas Jefferson School of Law Alumni Association Outstanding Service to the Community award. \nDanna is the current co-chair of the Lawyers Club Workplace Equity and Civility Initiative\, and will draw upon her professional experiences and expertise to speak about enhancing the workplace culture – through recognizing and addressing implicit bias\, and about the benefits of diversity\, civility\, and pay equity in the workplace.

SUMMARY:November 2019 MCLE Luncheon at Manhattan Restaurant
DESCRIPTION:Please calendar our next MCLE lunchtime program on Thursday\, November 14\, 2019\, at 12:00 pm at the Manhattan of La Jolla restaurant (within the Empress Hotel at 7766 Fay Avenue). We are very pleased to have attorney JOHN W. HANSON as this month’s speaker.  Mr. Hanson is a member of our association\, and practices exclusively in the are of consumer law.  \nHis presentation is entitled  “CONSUMER LAW: CAR SALES AND WARRANTY REPAIRS\,” and will draw upon his 20 years experience representing clients in litigation with car dealerships and car warranty providers.   \nThe program will focus on consumer protection laws and the practice of consumer law in these two areas: (1) consumer manipulation and abuse by dealerships during car purchase transactions; and (2) automobile defects and the remedies and limitations of California’s lemon law.  Mr. Hanson will also address how attorneys can assist clients (and themselves) on how to save thousands of dollars and avoid becoming victim to both car sales practices and warranty company “run-arounds.” \nThe program will  provide 1 hour of general  MCLE credit.\n\n \nSome information about our Speaker: \nJohn W. Hanson\, B.A.\, J.D.\, LL.M.\, practices exclusively in the area of consumer law\, with a focus on the lemon law and car dealer fraud. \n Mr. Hanson received  J.D. and B.A. degrees from the University of Iowa\, and an LL.M. from the University of London.  After graduating from law school in 1996\, Mr. Hanson clerked for an Iowa Supreme Court Justice\, and subsequently clerked for the Iowa Federal District Court.  After moving to California\, Mr. Hanson served as law clerk for the Honorable Nita L. Stormes\, Magistrate Judge\, United States District Court for the Southern District of California.   \n Mr. Hanson began his consumer law practice at a firm started by one of “Nader’s Raiders\,” and eventually opened  his own consumer-law practice more than  ten years ago.  In addition to his law practice\,  Mr. Hanson gives presentations on consumer law to public and professional groups\, and he teaches a course on consumer law at Miramar College.
