DESCRIPTION:ARIEL J. SABBAN will present “STRATEGIC LAWSUITS AGAINST PUBLIC PARTICIPATION (“SLAPP”)\,” in a program addressing SLAPP lawsuits\, which plaintiffs often use strategically to silence their critics through litigation\, and which abridge defendants’ constitutional rights of free speech and petition to government for redress of grievances.  These types of lawsuits are subject to special procedural treatment by Code of Civil Procedure § 425.16 (the “anti-SLAPP” statute)\, and Ariel’s presentation will explore the procedural mechanism and updated requirements for bringing successful anti-SLAPP motions in California. \nIf you have not attended a lunchtime program since our move to the Living Room Coffee House & Bistro\, please make it a point to do so. Neuharth\, Jr.\, as our July speaker\, presenting “MENTAL HEALTH ISSUES IN CRIMINAL LAW\,” in which he will discuss the impact of mental health issues on the Criminal Justice system\, and how cases involving criminal activities related to mental health issues are currently handled by our California Superior Courts. During his discussion\, Paul will address relevant homeless mental health issues; the role and function of the Mental Health Court; the involvement of the Veterans Administration with these problems; and the application of current Criteria of the Diagnostic and Statistical Manual of Mental Disorders (“DSM 5” criteria)\, among other things. \nOur speaker is a well known and highly respected member of the California Criminal Defense Bar\, with dual expertise in criminal and administrative law proceedings and hearings\, and has developed  knowledge and insights in these practices areas representing clients in such matters for 35 years\, and  from 7 years as a California State Law Enforcement Officer\, during which time he concurrently earned both his undergraduate and juris doctorate degrees. \nThis program is topical\, given current focus in the news on mental illness\, homelessness\, and the difficulty associated with attempting to address these matters as and when they present in the Criminal Justice System.  It is certain to be an interesting and insightful program for all of our members\, regardless of practice area. \nWe hope that all of you can attend this 1.0 hr MCLE credit program. \nNote: While this will be an “in-person” presentation\, those of you unable to attend in-person may participate through Zoom meeting access.

DESCRIPTION:We are very pleased to have as our November speaker\, attorney ELLIOT C. ROTHENBERG\,  who will discuss the anatomy of a United States Supreme Court case\, from his perspective as a sole practitioner.  Elliot will refer to\, and provide a “blow-by-blow” account of the historically significant Cohen v. Cowles Media litigation\, which he handled from start to successful finish\, establishing that First Amendment protection of reporter-source confidentiality is not limited to protecting only the press\, but extends confidentiality protection to the information source (i.e.\, our speaker’s client\, Dan Cohen)\, and creates rights on the part of a source to enforce a promise of confidentiality given to it by a newspaper reporter or news journalist.  \nElliot will discuss his petition for certiorari to the United States Supreme Court\, and other materials which he submitted to the Court in the Cowles case\, notwithstanding the conventional wisdom and prognostications of experts that the Court would never grant review (let alone uphold the position of Elliot’s client\, Dan Cohen).   Elliot will also comment upon the connection between journalistic integrity and the unrestricted flow of news; the use of the First Amendment by the Press as a means to not only publish newsworthy information\, but for it to withhold such information from the public; and whether the First Amendment is a guaranty limited to freedom for the press\, or is instead a guaranty of freedom for the dissemination of information to the public. \nOur speaker is looking forward to a lively presentation to our group\, and encourages questions and discussion from all who participate in the program. \nThe program will 1.0 hour general participatory credit. \n  \nSome Information about our Speaker:\n  \nElliot C. Rothenberg is a Minneapolis attorney specializing in Communications and First Amendment Law.  His most recognized victory was in the landmark case of Cohen v. Cowles Media Co.\, 501 U.S. 663 (1991)\, in which he was the sole attorney for the plaintiff\, Dan Cohen\, representing Mr. Cohen from pretrial motions; through a three-week trial in Minneapolis;  through two state court appeals; and then through petition for certiorari to\, and written and oral argument before\, the United States Supreme Court\, which decided in favor of Elliot’s client\, holding that the First Amendment does not grant media organizations immunity from generally applicable laws like the law of contracts.  \nThe favorable SCOTUS favorable decision was then followed by a second and final go-around in the Minnesota Supreme Court\, for which Elliot continued representation of Mr. Cohen through successful conclusion.  His entire papers and related materials for the Cohen case are now archived at the Harvard Law School Library.   \nElliot is the author of The Taming of the Press (Praeger 1999) still in print;  a co-author of Defending the First (Erlbaum 2004);  and has written numerous articles in law reviews\, newspapers\, and magazines.  \nHe was a Fulbright Fellow in his early twenties\, and 50 years later was appointed a Fulbright Ambassador.  Among other things besides practicing law for many years\, Elliot served as a Minnesota State Representative; and most recently was a recipient of the University of Minnesota College of Liberal Arts Outstanding Alumnus Award.   \nElliot is still “at it\,” and continues with his law practice at age 83.

Working with Senator Denise Ducheny’s office\, Ms. Welsh helped to introduce Senate Bill 931\, to protect consumers from their lenders when they are unable to pay off the balance of their mortgage loan. The bill created California Code of Civil Procedure §580e\, and made it mandatory for lenders to forgive the remaining balance of the mortgage debt when the borrower completes a short sale of their home. Mrs. Welsh-Levin has considerable knowledge regarding short sales\, foreclosures\, and loan modifications. \nMrs. Welsh-Levin holds the degree of Juris Doctor from California Western School of Law in San Diego\, California. Levy (1974)\, a landmark Supreme Court Case concerning the First Amendment rights of military personnel; Feres v. United States (1950)\, a Supreme Court case involving military service members and the Federal Torts Claims Act; and the USS VINCENNES (CG 49) incident involving Iran Air Flight 655 (1988). \n\nInformation about Our Speakers:\nLCDR Terence Sanders\, USN\, JAGC\nLieutenant Commander Terence R. Sanders currently serves as Staff Judge Advocate\, Surface and Mine Warfighting Development Center. He was born in Yokosuka\, Japan and earned his bachelor of science\, majoring in business management\, from the Tulane University in 2012\, and received his juris doctor from University of San Diego School of Law in 2018. He was commissioned in the United States Navy in May 2012 through Naval Reserve Officer Training Corps in New Orleans\, Louisiana. From 2012 to 2015\, LCDR Sanders served forward deployed as the Gunnery Officer\, Combat Electronics Officer\, and Assistant Combat Systems Officer aboard USS SHILOH (CG 67)\, homeported out of Yokosuka\, Japan. From July 2015 to August 2018\, LCDR Sanders attended the University of San Diego School of Law through the Law Education Program (LEP). During this time\, he was attached to Region Legal Service Office (RLSO) Southwest\, in both the command services and trial departments. From 2018 – 2020\, he completed his First Tour Judge Advocate (FTJA) rotation out of Yokosuka\, Japan at RLSO Japan. From 2020 – 2022\, he served as the Assistant Department Head of Command Services at Region Legal Service Office Mid-Atlantic. LCDR Sanders’ personal awards include the Navy Commendation Medal and Navy and Marine Corps Achievement Medal. \n  \nCDR John-Paul Mantone\, USN\nA native of Long Island\, NY\, Commander John-Paul (JP) Mantone graduated from Villanova University and was commissioned through the Naval Reserve Officer Training Corps (NROTC) in 2003. His sea tours include serving as Auxiliaries Officer in USS DOYLE (FFG 39) in Mayport\, FL and as Training officer in USS OSCAR AUSTIN (DDG 79) in Norfolk\, VA. Following these tours\, he served as an exchange officer with the British Royal Navy as a Bridge Watchkeeper in HMS CORNWALL (F99)\, based in Plymouth\, UK. Mantone then served as the Chief Engineer in USS SAMPSON (DDG 102) in San Diego\, CA; as Operations Officer in USS SHILOH (CG 67)\, forward-deployed to Yokosuka\, Japan; and most recently as the Executive Officer in USS FREEDOM (LCS 1)\, in San Diego\, CA. Gordon is one of the creators of and an instructor at the San Diego Family Law College of Trial Advocacy.   \nGordon served as a Special Master in over 375 matters overseeing issues of asset division\, valuation\, characterization\, income determination\, discovery and electronic discovery. Gordon serves as a mediator on Family Law and electronic discovery matters. (Gordon has completed the Harvard University Mediation program)  \nGordon serves as a privately compensated temporary judge in Family Law matters hearing all aspects of the case through trial.  \nGordon serves as an expert witness in Family Law matters and electronic discovery matters.  \nGordon received the Norby Award from the San Diego Superior Court Judiciary in 1998 for his work with the court and his excellence in the practice of family law. (Retired)\, and currently active as a mediator\, arbitrator\, special master and discovery referee with JAMS. \n  \nThursday\, September 8\, 2022\n12:00 pm via Zoom meeting\nJudge Gonzalez will draw on her extensive experience in presenting “Judging From the Bench and Judging as a Mediator\, the Differences.”  (1.0 hr CLE credit.) \n  \nInformation about Our Speaker:\n\nJudge Gonzalez\, a retired United States District Court Judge\, is presently a neutral with JAMS where she is a mediator\, arbitrator\, special master and discovery referee.  She was appointed to the United States District Court for the Southern District of California on August 12\, 1992\, becoming the first Latina of Mexican heritage to be appointed to the federal bench.  She served as Chief Judge of the District Court from January\, 2005 to January\, 2012.  Judge Gonzalez served as a judge on the Superior Court\, San Diego County (1991-1992) and as a Magistrate Judge\, Southern District of California (1984-1991).  Judge Gonzalez retired from the federal bench in October\, 2013. \nJudge Gonzalez graduated from Stanford University in 1970 and received her law degree from the University of Arizona School of Law\, now known as the James E. Rogers School of Law\, in 1973.   \nJudge Gonzalez served as a law clerk to United States District Judge\, William C. Frey in Tucson\, Arizona (1973-1975).  She served as an Assistant United States Attorney in the criminal division of the United States Attorney’s Office in the District of Arizona and the Central District of California (1975-1982).  Judge Gonzalez was a civil litigator in private practice with the law firm\, then known as Seltzer Caplan Wilkins & McMahon\, from 1982-1984. \nJudge Gonzalez is a founding member of Latinas in the Law and is on the Lawyers Club Advisory Board.  She is on the Board of the Association of Business Trial Lawyers.   \nJudge Gonzalez is a Master of the William B. Enright Inn of Court.  She is also on the Board of Trustees of the San Diego Humane Society and on the Board of Trustees of Scripps Health. Judge Gonzalez is a member of the San Diego Downtown Breakfast Rotary Club. \nIn 2008 Judge Gonzalez was named Outstanding Jurist by the San Diego County Bar Association.  In 2011 she received the Joan Dempsey Klein distinguished Jurist award from the California Women Lawyers and in 2013 Judge Gonzalez received the Lifetime Achievement Award from the Hispanic National Bar Association. In 2015 the University of Arizona\, James Rogers School of Law\, awarded Judge Gonzalez a Lifetime Achievement Award.  \nIn 2017 Judge Gonzalez was inducted into the San Diego Women’s Hall of Fame. In 2021 Judge Gonzalez was awarded the  Lawyer’s Club Excellence in Diversity Award; and she was selected that same year to be a recipient of the ABA Commission on Women in the Profession Margaret Brent Award. \nJudge Gonzalez is married to attorney Robert Brewer\, the former United States Attorney for the Southern District of California. They have a married daughter and two granddaughters. \n
