DESCRIPTION:We are very pleased to have as our November speaker\, attorney ELLIOT C. ROTHENBERG\,  who will discuss the anatomy of a United States Supreme Court case\, from his perspective as a sole practitioner.  Elliot will refer to\, and provide a “blow-by-blow” account of the historically significant Cohen v. Cowles Media litigation\, which he handled from start to successful finish\, establishing that First Amendment protection of reporter-source confidentiality is not limited to protecting only the press\, but extends confidentiality protection to the information source (i.e.\, our speaker’s client\, Dan Cohen)\, and creates rights on the part of a source to enforce a promise of confidentiality given to it by a newspaper reporter or news journalist.  \nElliot will discuss his petition for certiorari to the United States Supreme Court\, and other materials which he submitted to the Court in the Cowles case\, notwithstanding the conventional wisdom and prognostications of experts that the Court would never grant review (let alone uphold the position of Elliot’s client\, Dan Cohen).   Elliot will also comment upon the connection between journalistic integrity and the unrestricted flow of news; the use of the First Amendment by the Press as a means to not only publish newsworthy information\, but for it to withhold such information from the public; and whether the First Amendment is a guaranty limited to freedom for the press\, or is instead a guaranty of freedom for the dissemination of information to the public. \nOur speaker is looking forward to a lively presentation to our group\, and encourages questions and discussion from all who participate in the program. \nThe program will 1.0 hour general participatory credit. \n  \nSome Information about our Speaker:\n  \nElliot C. Rothenberg is a Minneapolis attorney specializing in Communications and First Amendment Law.  His most recognized victory was in the landmark case of Cohen v. Cowles Media Co.\, 501 U.S. 663 (1991)\, in which he was the sole attorney for the plaintiff\, Dan Cohen\, representing Mr. Cohen from pretrial motions; through a three-week trial in Minneapolis;  through two state court appeals; and then through petition for certiorari to\, and written and oral argument before\, the United States Supreme Court\, which decided in favor of Elliot’s client\, holding that the First Amendment does not grant media organizations immunity from generally applicable laws like the law of contracts.  \nThe favorable SCOTUS favorable decision was then followed by a second and final go-around in the Minnesota Supreme Court\, for which Elliot continued representation of Mr. Cohen through successful conclusion.  His entire papers and related materials for the Cohen case are now archived at the Harvard Law School Library.   \nElliot is the author of The Taming of the Press (Praeger 1999) still in print;  a co-author of Defending the First (Erlbaum 2004);  and has written numerous articles in law reviews\, newspapers\, and magazines.  \nHe was a Fulbright Fellow in his early twenties\, and 50 years later was appointed a Fulbright Ambassador.  Among other things besides practicing law for many years\, Elliot served as a Minnesota State Representative; and most recently was a recipient of the University of Minnesota College of Liberal Arts Outstanding Alumnus Award.   \nElliot is still “at it\,” and continues with his law practice at age 83.

BUCKNER\nCBuckner@KlinedinstLaw.com \nCarole J. Buckner is Senior Counsel in Klinedinst’s San Diego office. Her law experience focuses on litigation in business\, employment\, real estate and professional liability matters\, including internal investigations. She has first chair trial experience in state and federal courts\, including jury trials\, as well as arbitration and mediation. She has advanced experience in legal ethics\, professional responsibility\, the law of lawyering\, and risk management\, including advising law firms and lawyers\, and rendering expert opinions on matters involving legal ethics. She also has also served as an arbitrator and mediator. Ms. Buckner has also served as general counsel\, managing outside counsel and coordinating with insurance issues.  \nShe has over five years of experience in the general counsel role for a large law firm\, over 10 years experience representing lawyers and law firms in legal ethics and professional responsibility\, 15 years of civil legal experience including litigation involving business and real estate disputes\, legal malpractice and employment litigation\, over 15 years of experience as a legal educator\, and over three years of experience as a federal prosecutor. She has served as a neutral handling arbitration since 2016 and mediation since 2020. \nMs. Buckner was a member of the California State Bar’s Committee on Professionalism and Conduct (COPRAC) starting in 2005. She served as COPRAC chair in 2009-2010\, and later as the Special Advisor to the Committee. She is a member and former Co-Chair of the Professionalism and Ethics Committee of the Orange County Bar Association\, and a member and former chair of the Los Angeles County Bar Association’s Committee on Professional Responsibility and Ethics Committee (PREC). In 1973 he graduated from Chaffey High School and elected to attend Claremont McKenna College in Claremont\, CA. By 1983 Greg had earned a law school degree from the University of La Verne College of Law and passed the California State Bar Exam. \n As an attorney\, Greg worked as a trial lawyer for the San Bernardino County Office of the District Attorney and as a private practitioner specializing in criminal defense and real estate litigation. In July of 1997\, Greg stopped practicing law and began a new chapter in his life. \n The year 2000 brought Certification as an Addiction Specialist and a career in the field of mental health and addiction. In 2004 Greg was selected to consult for The Other Bar\, working with attorneys\, judges and law students in need of help for substance abuse issues and mental health needs. DESCRIPTION:The La Jolla Bar Association’s Annual Summer Beach Party: \nLa Jolla Beach and Tennis Club\, 2000 Spindrift Drive\nFriday\, August 4th – 4:00 to 6:00 p.m.\nTables and chairs will be set up and our location\, Beach Sections U\, V\, W at the north of the Beach Club\, will be marked with a table sign. \nAs a convenience to our attendees this year\, the LJBA is providing Phil’s BBQ\, as well as soft drinks\, wine\, beer\, ice\, and side dishes for the group. A grill will be available for those of you wishing to bring your own food item to barbeque. \nCOME EARLY AND STAY LATE – you are welcome to arrive earlier in the day and use the Beach Club facility if you like. Welsh-Levin\, as our speaker this month. Shanna will speak about California’s Housing Policies\, during which she will review how recent state and local laws aimed at increasing housing density will adversely impact multifamily landlords’ management of their properties. The discussion will address how these policies intended to help fix California’s housing crisis can backfire\, causing higher costs for both landlords and tenants. Included within the discussion will be multifamily properties\, Accessory Dwelling Units\, eviction laws\, and short term rental restrictions. \nWe hope that all of you can attend this 1.0 hour MCLE credit program. \n\nInformation About Our Speaker:\nShanna E. Welsh-Levin \nAttorney Shanna Welsh-Levin is the owner and Senior Attorney of So Cal Realty Law. She is a member of the State Bar of California\, and the San Diego County Bar Association. Mrs. Welsh-Levin is a California licensed real estate broker and an active member of the San Diego Association of REALTORS®. She has served on committees at SDAR and attended legislative functions as a representative of the association. She is also a member of the California Association of REALTORS® and regularly attends the C.A.R. Legal Affairs Forum. \nMrs. Welsh-Levin has twenty years of experience handling real estate legal matters including litigation\, trials\, mediation\, and transactions. She represents real estate investors and professionals to prepare joint venture agreements\, purchase and sale agreements\, leases\, and related contracts\, and to enforce those contracts through the court\, if necessary. \nDuring the recession and housing crisis from 2007 through 2014\, Mrs. Welsh-Levin participated in hundreds of HOME Clinics that took place throughout San Diego County\, Imperial County\, and Riverside County. The clinics were sponsored by the U.S. Department of Housing and Urban Development. In doing this\, she developed a deem understanding of mortgage lending and servicing. \nMrs. Welsh-Levin is confident litigating against big mortgage banks and servicers on behalf of California property owners. Mrs. Welsh was instrumental in passing California’s short sale anti-deficiency statute. Working with Senator Denise Ducheny’s office\, Ms. Welsh helped to introduce Senate Bill 931\, to protect consumers from their lenders when they are unable to pay off the balance of their mortgage loan. The bill created California Code of Civil Procedure §580e\, and made it mandatory for lenders to forgive the remaining balance of the mortgage debt when the borrower completes a short sale of their home. Mrs. Welsh-Levin has considerable knowledge regarding short sales\, foreclosures\, and loan modifications. \nMrs. Welsh-Levin holds the degree of Juris Doctor from California Western School of Law in San Diego\, California. She graduated magna cum laude from the University of Pittsburgh\, earning a Bachelor of Arts degree in Anthropology and Jazz Music. DESCRIPTION:We are very pleased to welcome as our speakers for this event:\n  \nLCDR Terence Sanders\, USN\, JAGC and CDR John-Paul Mantone\, USN\nThursday\, February 9\, 2023\n12:00 pm via Zoom—AND—”in-person” at:\nHennessey’s Tavern Dining Room\n7811 Herschel Avenue\, La Jolla\, CA 92037 \n  \nWe are very pleased to have as our February speakers\, LCDR Terence Sanders\, USN\, JAGC and CDR John-Paul Mantone\, USN\, presenting an “Overview of the Military Justice System\,” in which they will: \n\nprovide an overview of the military justice system\, to include a general history describing its constitutional foundation\, statutory authorities\, and the adoption of the Uniform Code of Military Justice (UCMJ); \ngive a description of the U.S. Navy’s Judge Advocate General Corps (JAGC); \nexplain the unique structure of the military justice system; highlighting differences in the application of constitutional rights between the military and civilian justice systems; crossover areas with the civilian legal field; and \nillustrate a few examples of “operational law”; and discuss how legislation such as National Defense Authorization Act (NDAA) impacts the military justice system.\n\nIn examining the points above\, our speakers will also discuss several historical case studies and vignettes\, including Parker v. Levy (1974)\, a landmark Supreme Court Case concerning the First Amendment rights of military personnel; Feres v. United States (1950)\, a Supreme Court case involving military service members and the Federal Torts Claims Act; and the USS VINCENNES (CG 49) incident involving Iran Air Flight 655 (1988). \n\nInformation about Our Speakers:\nLCDR Terence Sanders\, USN\, JAGC\nLieutenant Commander Terence R. Sanders currently serves as Staff Judge Advocate\, Surface and Mine Warfighting Development Center. He was born in Yokosuka\, Japan and earned his bachelor of science\, majoring in business management\, from the Tulane University in 2012\, and received his juris doctor from University of San Diego School of Law in 2018. He was commissioned in the United States Navy in May 2012 through Naval Reserve Officer Training Corps in New Orleans\, Louisiana. From 2012 to 2015\, LCDR Sanders served forward deployed as the Gunnery Officer\, Combat Electronics Officer\, and Assistant Combat Systems Officer aboard USS SHILOH (CG 67)\, homeported out of Yokosuka\, Japan. From July 2015 to August 2018\, LCDR Sanders attended the University of San Diego School of Law through the Law Education Program (LEP). During this time\, he was attached to Region Legal Service Office (RLSO) Southwest\, in both the command services and trial departments. From 2018 – 2020\, he completed his First Tour Judge Advocate (FTJA) rotation out of Yokosuka\, Japan at RLSO Japan. From 2020 – 2022\, he served as the Assistant Department Head of Command Services at Region Legal Service Office Mid-Atlantic. LCDR Sanders’ personal awards include the Navy Commendation Medal and Navy and Marine Corps Achievement Medal. \n  \nCDR John-Paul Mantone\, USN\nA native of Long Island\, NY\, Commander John-Paul (JP) Mantone graduated from Villanova University and was commissioned through the Naval Reserve Officer Training Corps (NROTC) in 2003. His sea tours include serving as Auxiliaries Officer in USS DOYLE (FFG 39) in Mayport\, FL and as Training officer in USS OSCAR AUSTIN (DDG 79) in Norfolk\, VA. (Retired)\, and currently active as a mediator\, arbitrator\, special master and discovery referee with JAMS. \n  \nThursday\, September 8\, 2022\n12:00 pm via Zoom meeting\nJudge Gonzalez will draw on her extensive experience in presenting “Judging From the Bench and Judging as a Mediator\, the Differences.”  (1.0 hr CLE credit.) \n  \nInformation about Our Speaker:\n\nJudge Gonzalez\, a retired United States District Court Judge\, is presently a neutral with JAMS where she is a mediator\, arbitrator\, special master and discovery referee.  She was appointed to the United States District Court for the Southern District of California on August 12\, 1992\, becoming the first Latina of Mexican heritage to be appointed to the federal bench.  She served as Chief Judge of the District Court from January\, 2005 to January\, 2012.  Judge Gonzalez served as a judge on the Superior Court\, San Diego County (1991-1992) and as a Magistrate Judge\, Southern District of California (1984-1991).  Judge Gonzalez retired from the federal bench in October\, 2013. \nJudge Gonzalez graduated from Stanford University in 1970 and received her law degree from the University of Arizona School of Law\, now known as the James E. Rogers School of Law\, in 1973.   \nJudge Gonzalez served as a law clerk to United States District Judge\, William C. Frey in Tucson\, Arizona (1973-1975).  She served as an Assistant United States Attorney in the criminal division of the United States Attorney’s Office in the District of Arizona and the Central District of California (1975-1982).  Judge Gonzalez was a civil litigator in private practice with the law firm\, then known as Seltzer Caplan Wilkins & McMahon\, from 1982-1984. \nJudge Gonzalez is a founding member of Latinas in the Law and is on the Lawyers Club Advisory Board.  She is on the Board of the Association of Business Trial Lawyers.   \nJudge Gonzalez is a Master of the William B. Enright Inn of Court.  She is also on the Board of Trustees of the San Diego Humane Society and on the Board of Trustees of Scripps Health. Judge Gonzalez is a member of the San Diego Downtown Breakfast Rotary Club. \nIn 2008 Judge Gonzalez was named Outstanding Jurist by the San Diego County Bar Association.  In 2011 she received the Joan Dempsey Klein distinguished Jurist award from the California Women Lawyers and in 2013 Judge Gonzalez received the Lifetime Achievement Award from the Hispanic National Bar Association. In 2015 the University of Arizona\, James Rogers School of Law\, awarded Judge Gonzalez a Lifetime Achievement Award.  \nIn 2017 Judge Gonzalez was inducted into the San Diego Women’s Hall of Fame. In 2021 Judge Gonzalez was awarded the  Lawyer’s Club Excellence in Diversity Award; and she was selected that same year to be a recipient of the ABA Commission on Women in the Profession Margaret Brent Award. \nJudge Gonzalez is married to attorney Robert Brewer\, the former United States Attorney for the Southern District of California. SUMMARY:La Jolla Bar Association 2021 Summer Beach Party!
DESCRIPTION:Our association’s summer beach party and picnic will be held at: \nLa Jolla Beach and Tennis Club\nFriday\, August 13\, 2021\nbeginning at 4:00 p.m.\nTables will be set up and our location will be marked with a table sign. \nAs a convenience to our attendees this year\, the LJBA is providing Mexican cuisine\, as well as soft drinks\, wine\, beer\, ice\, side dishes\, and desserts for the group. Tables and chairs will be provided\, along with charcoal and barbecue grills for those wishing to bring their own meat\, fish or other entree to barbecue. \nCOME EARLY AND STAY LATE – you are welcome to arrive earlier in the day and use the Beach Club facility if you like.
