SABRAW\, Judge\nUnited States District Court for the Southern District of California \nFederal Judicial Service: \nJudge\, U.S. District Court for the Southern District of California Nominated by POTUS George W. Bush on May 1\, 2003\, to a new seat authorized by 116 Stat. 1758. Confirmed by the Senate on September 25\, 2003\, and received commission on September 26\, 2003. \nJudge Sabraw served as Chief Judge of the Court from January 22\, 2021 to January 22\, 2025. \nEducation: \nAmerican River Junior College\, A.A.\, 1978\nSan Diego State University\, B.S.\, 1980\nUniversity of the Pacific\, McGeorge School of Law\, J.D.\, 1985 \nEarlier Professional Career: \nPrivate practice\, Santa Barbara\, California\, 1985-1989 \nPrivate practice\, San Diego\, California\, 1989-1995 \nJudge\, San Diego [California] North County Municipal Court\, 1995-1998 \nJudge\, Superior Court of California\, County of San Diego\, 1998-2003 \nAdditional Information about Judge Sabraw: \nJudge Dana Makoto Sabraw was appointed to the United States District Court in 2003. He served as Chief Judge from January 22\, 2021 to January 22\, 2025. He received his undergraduate degree with distinction from San Diego State University\, and thereafter attended McGeorge School of Law at the University of the Pacific\, where he graduated in 1985 in the top 10% of his class and served on the Law Review. Before his appointment\, Judge Sabraw practiced law as a commercial litigator with Baker & McKenzie in San Diego\, becoming a partner in 1992. In 1995\, he was appointed to San Diego’s North County Municipal Court. He served as Presiding Judge of the Municipal Court until his elevation to the Superior Court in 1998\, where he served as Criminal Supervising Judge and as a criminal and civil trial judge until his appointment to the federal bench. As a trial lawyer and judge\, Judge Sabraw has tried more than 300 cases to verdict. \nJudge Sabraw was appointed by the Chief Justice of the United States Supreme Court to serve as a member of the U.S. Judicial Conference Committee on the Judicial Branch\, and he was appointed by the Director of the Administrative Office of the U.S. Courts to serve as a member of the Judicial Security and Independence Task Force. He has been active in a number of professional organizations. Among these\, he is a founding member and past president of two American Inns of Court (Lopardo and Wallace Inn Chapters)\, and current member\, and past board member\, of the Pan Asian Lawyers of San Diego. He also serves on the founding committee of “Just the Beginning—A Pipeline Organization.” He is a frequent speaker at law and community related events on judicial independence and the rule of law. \nHe has received numerous awards from the community and bar associations\, including Person of the Year by the San Diego Union Tribune editorial board (2018)\, Outstanding Jurist by the San Diego County Bar Association (2019)\, Judge of the Year by La Raza Lawyers Association of San Diego (2019)\, Humanitarian of the Year by Casa Cornelia Law Center(2019)\, Judge of the Year by Consumer Trial Attorneys of San Diego (2019)\, and the Bernard E. SCHAPIRO\nDean and C. Hugh Friedman Professor of Law\nUniversity of San Diego School of Law\n  \nRobert A. Schapiro is Dean and C. Hugh Friedman Professor of Law at the University of San Diego School of Law.  He obtained a B.A. from Yale College\, M.A. from Stanford University\, and J.D. from Yale Law School\, where he served as editor-in-chief of the Yale Law Journal.  Schapiro clerked for Justice John Paul Stevens of the U.S. Supreme Court and for Judge Pierre N. Leval of the U.S. District Court for the Southern District of New York.\n\nPrior to becoming Dean at the USD School of Law in 2021\, Schapiro was a faculty member at Emory University School of Law.  At Emory\, he served as Dean and Asa Griggs Candler Professor of Law and Co-Director of the Center on Federalism and Intersystemic Governance. He had previously held positions as associate vice provost for academic affairs\, associate dean of faculty for the law school\, and as associate faculty director for Emory’s Halle Institute for Global Learning.\n\nSchapiro received the 2023 Witkin Award for Excellence in Legal Education from the San Diego Library Foundation.  While at Emory\, Schapiro received several awards\, including the Emory Williams Distinguished Teaching Award for excellence in graduate education\, the Ben F. Johnson Faculty Excellence Award\, Most Outstanding Professor from the Emory Student Bar Association\, and Professor of the Year from the Emory Law School Black Law Students Association.\n\nSchapiro’s scholarship focuses on federalism and state and federal constitutional law. DESCRIPTION:We are very pleased to have Paul H. Neuharth\, Jr.\, as our July speaker\, presenting “MENTAL HEALTH ISSUES IN CRIMINAL LAW\,” in which he will discuss the impact of mental health issues on the Criminal Justice system\, and how cases involving criminal activities related to mental health issues are currently handled by our California Superior Courts. During his discussion\, Paul will address relevant homeless mental health issues; the role and function of the Mental Health Court; the involvement of the Veterans Administration with these problems; and the application of current Criteria of the Diagnostic and Statistical Manual of Mental Disorders (“DSM 5” criteria)\, among other things. \nOur speaker is a well known and highly respected member of the California Criminal Defense Bar\, with dual expertise in criminal and administrative law proceedings and hearings\, and has developed  knowledge and insights in these practices areas representing clients in such matters for 35 years\, and  from 7 years as a California State Law Enforcement Officer\, during which time he concurrently earned both his undergraduate and juris doctorate degrees. \nThis program is topical\, given current focus in the news on mental illness\, homelessness\, and the difficulty associated with attempting to address these matters as and when they present in the Criminal Justice System.  It is certain to be an interesting and insightful program for all of our members\, regardless of practice area. \nWe hope that all of you can attend this 1.0 hr MCLE credit program. \nNote: While this will be an “in-person” presentation\, those of you unable to attend in-person may participate through Zoom meeting access.

ROTHENBERG\,  who will discuss the anatomy of a United States Supreme Court case\, from his perspective as a sole practitioner.  Elliot will refer to\, and provide a “blow-by-blow” account of the historically significant Cohen v. Cowles Media litigation\, which he handled from start to successful finish\, establishing that First Amendment protection of reporter-source confidentiality is not limited to protecting only the press\, but extends confidentiality protection to the information source (i.e.\, our speaker’s client\, Dan Cohen)\, and creates rights on the part of a source to enforce a promise of confidentiality given to it by a newspaper reporter or news journalist.  \nElliot will discuss his petition for certiorari to the United States Supreme Court\, and other materials which he submitted to the Court in the Cowles case\, notwithstanding the conventional wisdom and prognostications of experts that the Court would never grant review (let alone uphold the position of Elliot’s client\, Dan Cohen).   Elliot will also comment upon the connection between journalistic integrity and the unrestricted flow of news; the use of the First Amendment by the Press as a means to not only publish newsworthy information\, but for it to withhold such information from the public; and whether the First Amendment is a guaranty limited to freedom for the press\, or is instead a guaranty of freedom for the dissemination of information to the public. \nOur speaker is looking forward to a lively presentation to our group\, and encourages questions and discussion from all who participate in the program. \nThe program will 1.0 hour general participatory credit. \n  \nSome Information about our Speaker:\n  \nElliot C. Rothenberg is a Minneapolis attorney specializing in Communications and First Amendment Law.  His most recognized victory was in the landmark case of Cohen v. Cowles Media Co.\, 501 U.S. 663 (1991)\, in which he was the sole attorney for the plaintiff\, Dan Cohen\, representing Mr. Cohen from pretrial motions; through a three-week trial in Minneapolis;  through two state court appeals; and then through petition for certiorari to\, and written and oral argument before\, the United States Supreme Court\, which decided in favor of Elliot’s client\, holding that the First Amendment does not grant media organizations immunity from generally applicable laws like the law of contracts.  \nThe favorable SCOTUS favorable decision was then followed by a second and final go-around in the Minnesota Supreme Court\, for which Elliot continued representation of Mr. Cohen through successful conclusion.  His entire papers and related materials for the Cohen case are now archived at the Harvard Law School Library.   \nElliot is the author of The Taming of the Press (Praeger 1999) still in print;  a co-author of Defending the First (Erlbaum 2004);  and has written numerous articles in law reviews\, newspapers\, and magazines.  \nHe was a Fulbright Fellow in his early twenties\, and 50 years later was appointed a Fulbright Ambassador.  Among other things besides practicing law for many years\, Elliot served as a Minnesota State Representative; and most recently was a recipient of the University of Minnesota College of Liberal Arts Outstanding Alumnus Award.   \nElliot is still “at it\,” and continues with his law practice at age 83.

In 1973 he graduated from Chaffey High School and elected to attend Claremont McKenna College in Claremont\, CA. By 1983 Greg had earned a law school degree from the University of La Verne College of Law and passed the California State Bar Exam. \n As an attorney\, Greg worked as a trial lawyer for the San Bernardino County Office of the District Attorney and as a private practitioner specializing in criminal defense and real estate litigation. In July of 1997\, Greg stopped practicing law and began a new chapter in his life. \n The year 2000 brought Certification as an Addiction Specialist and a career in the field of mental health and addiction. In 2004 Greg was selected to consult for The Other Bar\, working with attorneys\, judges and law students in need of help for substance abuse issues and mental health needs. Welsh-Levin\, as our speaker this month. Shanna will speak about California’s Housing Policies\, during which she will review how recent state and local laws aimed at increasing housing density will adversely impact multifamily landlords’ management of their properties. The discussion will address how these policies intended to help fix California’s housing crisis can backfire\, causing higher costs for both landlords and tenants. Included within the discussion will be multifamily properties\, Accessory Dwelling Units\, eviction laws\, and short term rental restrictions. \nWe hope that all of you can attend this 1.0 hour MCLE credit program. \n\nInformation About Our Speaker:\nShanna E. Welsh-Levin \nAttorney Shanna Welsh-Levin is the owner and Senior Attorney of So Cal Realty Law. She is a member of the State Bar of California\, and the San Diego County Bar Association. Mrs. Welsh-Levin is a California licensed real estate broker and an active member of the San Diego Association of REALTORS®. She has served on committees at SDAR and attended legislative functions as a representative of the association. She is also a member of the California Association of REALTORS® and regularly attends the C.A.R. Legal Affairs Forum. \nMrs. Welsh-Levin has twenty years of experience handling real estate legal matters including litigation\, trials\, mediation\, and transactions. She represents real estate investors and professionals to prepare joint venture agreements\, purchase and sale agreements\, leases\, and related contracts\, and to enforce those contracts through the court\, if necessary. \nDuring the recession and housing crisis from 2007 through 2014\, Mrs. Welsh-Levin participated in hundreds of HOME Clinics that took place throughout San Diego County\, Imperial County\, and Riverside County. The clinics were sponsored by the U.S. Department of Housing and Urban Development. In doing this\, she developed a deem understanding of mortgage lending and servicing. \nMrs. Welsh-Levin is confident litigating against big mortgage banks and servicers on behalf of California property owners. Mrs. Welsh was instrumental in passing California’s short sale anti-deficiency statute. Working with Senator Denise Ducheny’s office\, Ms. Welsh helped to introduce Senate Bill 931\, to protect consumers from their lenders when they are unable to pay off the balance of their mortgage loan. The bill created California Code of Civil Procedure §580e\, and made it mandatory for lenders to forgive the remaining balance of the mortgage debt when the borrower completes a short sale of their home. Mrs. Welsh-Levin has considerable knowledge regarding short sales\, foreclosures\, and loan modifications. \nMrs. Welsh-Levin holds the degree of Juris Doctor from California Western School of Law in San Diego\, California. She graduated magna cum laude from the University of Pittsburgh\, earning a Bachelor of Arts degree in Anthropology and Jazz Music.
