Welsh-Levin\, as our speaker this month. Shanna will speak about California’s Housing Policies\, during which she will review how recent state and local laws aimed at increasing housing density will adversely impact multifamily landlords’ management of their properties. The discussion will address how these policies intended to help fix California’s housing crisis can backfire\, causing higher costs for both landlords and tenants. Included within the discussion will be multifamily properties\, Accessory Dwelling Units\, eviction laws\, and short term rental restrictions. \nWe hope that all of you can attend this 1.0 hour MCLE credit program. \n\nInformation About Our Speaker:\nShanna E. Welsh-Levin \nAttorney Shanna Welsh-Levin is the owner and Senior Attorney of So Cal Realty Law. She is a member of the State Bar of California\, and the San Diego County Bar Association. Mrs. Welsh-Levin is a California licensed real estate broker and an active member of the San Diego Association of REALTORS®. She has served on committees at SDAR and attended legislative functions as a representative of the association. She is also a member of the California Association of REALTORS® and regularly attends the C.A.R. Legal Affairs Forum. \nMrs. Welsh-Levin has twenty years of experience handling real estate legal matters including litigation\, trials\, mediation\, and transactions. She represents real estate investors and professionals to prepare joint venture agreements\, purchase and sale agreements\, leases\, and related contracts\, and to enforce those contracts through the court\, if necessary. \nDuring the recession and housing crisis from 2007 through 2014\, Mrs. Welsh-Levin participated in hundreds of HOME Clinics that took place throughout San Diego County\, Imperial County\, and Riverside County. The clinics were sponsored by the U.S. Department of Housing and Urban Development. In doing this\, she developed a deem understanding of mortgage lending and servicing. \nMrs. Welsh-Levin is confident litigating against big mortgage banks and servicers on behalf of California property owners. Mrs. Welsh was instrumental in passing California’s short sale anti-deficiency statute. Working with Senator Denise Ducheny’s office\, Ms. Welsh helped to introduce Senate Bill 931\, to protect consumers from their lenders when they are unable to pay off the balance of their mortgage loan. The bill created California Code of Civil Procedure §580e\, and made it mandatory for lenders to forgive the remaining balance of the mortgage debt when the borrower completes a short sale of their home. Mrs. Welsh-Levin has considerable knowledge regarding short sales\, foreclosures\, and loan modifications. \nMrs. Welsh-Levin holds the degree of Juris Doctor from California Western School of Law in San Diego\, California. She graduated magna cum laude from the University of Pittsburgh\, earning a Bachelor of Arts degree in Anthropology and Jazz Music. DESCRIPTION:We are very pleased to welcome as our speakers for this event:\n  \nLCDR Terence Sanders\, USN\, JAGC and CDR John-Paul Mantone\, USN\nThursday\, February 9\, 2023\n12:00 pm via Zoom—AND—”in-person” at:\nHennessey’s Tavern Dining Room\n7811 Herschel Avenue\, La Jolla\, CA 92037 \n  \nWe are very pleased to have as our February speakers\, LCDR Terence Sanders\, USN\, JAGC and CDR John-Paul Mantone\, USN\, presenting an “Overview of the Military Justice System\,” in which they will: \n\nprovide an overview of the military justice system\, to include a general history describing its constitutional foundation\, statutory authorities\, and the adoption of the Uniform Code of Military Justice (UCMJ); \ngive a description of the U.S. Navy’s Judge Advocate General Corps (JAGC); \nexplain the unique structure of the military justice system; highlighting differences in the application of constitutional rights between the military and civilian justice systems; crossover areas with the civilian legal field; and \nillustrate a few examples of “operational law”; and discuss how legislation such as National Defense Authorization Act (NDAA) impacts the military justice system.\n\nIn examining the points above\, our speakers will also discuss several historical case studies and vignettes\, including Parker v. Levy (1974)\, a landmark Supreme Court Case concerning the First Amendment rights of military personnel; Feres v. United States (1950)\, a Supreme Court case involving military service members and the Federal Torts Claims Act; and the USS VINCENNES (CG 49) incident involving Iran Air Flight 655 (1988). \n\nInformation about Our Speakers:\nLCDR Terence Sanders\, USN\, JAGC\nLieutenant Commander Terence R. Sanders currently serves as Staff Judge Advocate\, Surface and Mine Warfighting Development Center. He was born in Yokosuka\, Japan and earned his bachelor of science\, majoring in business management\, from the Tulane University in 2012\, and received his juris doctor from University of San Diego School of Law in 2018. He was commissioned in the United States Navy in May 2012 through Naval Reserve Officer Training Corps in New Orleans\, Louisiana. From 2012 to 2015\, LCDR Sanders served forward deployed as the Gunnery Officer\, Combat Electronics Officer\, and Assistant Combat Systems Officer aboard USS SHILOH (CG 67)\, homeported out of Yokosuka\, Japan. From July 2015 to August 2018\, LCDR Sanders attended the University of San Diego School of Law through the Law Education Program (LEP). During this time\, he was attached to Region Legal Service Office (RLSO) Southwest\, in both the command services and trial departments. From 2018 – 2020\, he completed his First Tour Judge Advocate (FTJA) rotation out of Yokosuka\, Japan at RLSO Japan. From 2020 – 2022\, he served as the Assistant Department Head of Command Services at Region Legal Service Office Mid-Atlantic. LCDR Sanders’ personal awards include the Navy Commendation Medal and Navy and Marine Corps Achievement Medal. \n  \nCDR John-Paul Mantone\, USN\nA native of Long Island\, NY\, Commander John-Paul (JP) Mantone graduated from Villanova University and was commissioned through the Naval Reserve Officer Training Corps (NROTC) in 2003. His sea tours include serving as Auxiliaries Officer in USS DOYLE (FFG 39) in Mayport\, FL and as Training officer in USS OSCAR AUSTIN (DDG 79) in Norfolk\, VA. Following these tours\, he served as an exchange officer with the British Royal Navy as a Bridge Watchkeeper in HMS CORNWALL (F99)\, based in Plymouth\, UK. Mantone then served as the Chief Engineer in USS SAMPSON (DDG 102) in San Diego\, CA; as Operations Officer in USS SHILOH (CG 67)\, forward-deployed to Yokosuka\, Japan; and most recently as the Executive Officer in USS FREEDOM (LCS 1)\, in San Diego\, CA. Ashore\, Mantone attended the U.S. Naval War College in Newport\, RI\, where he earned a Master of Arts in National Security and Strategic Studies. In Washington\, DC\, he served at the Pentagon on the staff of the Deputy Under Secretary of the Navy (Policy) and on Capitol Hill as a Legislative Fellow for Senator Susan Collins (Maine)\, a member of the Senate Appropriations Committee and the Select Committee on Intelligence. His current assignment is serving as the Chief Staff Officer for Mine Division TWELVE (MINEDIV-12) in San Diego\, CA. His awards include the Navy Commendation Medal (four awards)\, Navy Achievement Medal (three awards)\, and several campaign and unit awards. \n

Dean Schapiro clerked for Justice John Paul Stevens of the U.S. Supreme Court and for Judge Pierre N. Gordon serves as a mediator on Family Law and electronic discovery matters. (Retired)\, and currently active as a mediator\, arbitrator\, special master and discovery referee with JAMS. \n  \nThursday\, September 8\, 2022\n12:00 pm via Zoom meeting\nJudge Gonzalez will draw on her extensive experience in presenting “Judging From the Bench and Judging as a Mediator\, the Differences.”  (1.0 hr CLE credit.) \n  \nInformation about Our Speaker:\n\nJudge Gonzalez\, a retired United States District Court Judge\, is presently a neutral with JAMS where she is a mediator\, arbitrator\, special master and discovery referee.  She was appointed to the United States District Court for the Southern District of California on August 12\, 1992\, becoming the first Latina of Mexican heritage to be appointed to the federal bench.  She served as Chief Judge of the District Court from January\, 2005 to January\, 2012.  Judge Gonzalez served as a judge on the Superior Court\, San Diego County (1991-1992) and as a Magistrate Judge\, Southern District of California (1984-1991).  Judge Gonzalez retired from the federal bench in October\, 2013. \nJudge Gonzalez graduated from Stanford University in 1970 and received her law degree from the University of Arizona School of Law\, now known as the James E. Rogers School of Law\, in 1973.   \nJudge Gonzalez served as a law clerk to United States District Judge\, William C. Frey in Tucson\, Arizona (1973-1975).  She served as an Assistant United States Attorney in the criminal division of the United States Attorney’s Office in the District of Arizona and the Central District of California (1975-1982).  Judge Gonzalez was a civil litigator in private practice with the law firm\, then known as Seltzer Caplan Wilkins & McMahon\, from 1982-1984. \nJudge Gonzalez is a founding member of Latinas in the Law and is on the Lawyers Club Advisory Board.  She is on the Board of the Association of Business Trial Lawyers.   \nJudge Gonzalez is a Master of the William B. Enright Inn of Court.  She is also on the Board of Trustees of the San Diego Humane Society and on the Board of Trustees of Scripps Health. Judge Gonzalez is a member of the San Diego Downtown Breakfast Rotary Club. \nIn 2008 Judge Gonzalez was named Outstanding Jurist by the San Diego County Bar Association.  In 2011 she received the Joan Dempsey Klein distinguished Jurist award from the California Women Lawyers and in 2013 Judge Gonzalez received the Lifetime Achievement Award from the Hispanic National Bar Association. In 2015 the University of Arizona\, James Rogers School of Law\, awarded Judge Gonzalez a Lifetime Achievement Award.  \nIn 2017 Judge Gonzalez was inducted into the San Diego Women’s Hall of Fame. In 2021 Judge Gonzalez was awarded the  Lawyer’s Club Excellence in Diversity Award; and she was selected that same year to be a recipient of the ABA Commission on Women in the Profession Margaret Brent Award. \nJudge Gonzalez is married to attorney Robert Brewer\, the former United States Attorney for the Southern District of California. They have a married daughter and two granddaughters. \n

She is a member of the Real Property Law Section Executive Committee\, and was elected Chair of the Real Property Law Section during 2015.  \nMrs. Welsh-Levin is a California licensed real estate broker and an active member of the San Diego Association of REALTORS®.  She has served on committees at SDAR\, and attended legislative functions as a representative of the association.  She is also a member of the California Association of REALTORS®\, and the National Association of REALTORS®.   \nDuring the recession and housing crisis from 2007 through 2014\, Mrs. Welsh-Levin participated in hundreds of HOME Clinics that took place throughout San Diego County\, Imperial County\, and Riverside County. The clinics were sponsored by the U.S. Department of Housing and Urban Development.  As a volunteer attorney at these events\, Ms. Welsh-Levin consulted with homeowners who were in distress because of their mortgages. \nShe was instrumental in passing California’s short sale anti-deficiency statute. Working with Senator Denise Ducheny’s office\, Ms. Welsh helped to introduce Senate Bill 931\, to protect consumers from their lenders when they are unable to pay off the balance of their mortgage loan.  The bill passed and made it mandatory for lenders to forgive the remaining balance of the mortgage debt\, called the deficiency balance\, when the homeowner/borrower completes a short sale of their home.  When the bill went into effect on January 1\, 2011\, it created the California Code of Civil Procedure §580e.   \nMrs. Welsh-Levin counsels attorneys\, real estate professionals\, housing counselors\, negotiators\, and property owners about the law on short sales\, foreclosures\, and loan modifications.     \nAttorney Welsh-Levin opened her law office\, So. Cal. Realty Law\, APC\, in September 2011.  Prior to creating her own law firm\, Ms. Welsh worked for many years at the Law Offices of Michael Spilger\, an exclusive real estate law firm. DESCRIPTION:Our next MCLE lunchtime program will be Thursday\, February 11th at 12:00 pm\, via Zoom Meeting. We are very pleased to have Devin Burstein\, as our speaker for this lunchtime event.  \n  \nDevin Burstein\, partner at Warren & Burstein\, is our speaker for February\, presenting: “A Glimmer of Hope: Federal Compassionate Release and the Pandemic”. \nIn this presentation Mr. Burstein will address the intersection of the pandemic and federal compassionate release\, providing an overview of the process involved in seeking relief; practice tips; and will discuss what is really going on in federal prisons in terms of COVID-19.  \nMr. Burstein has provided our members with excellent past presentations\, and you will not want to miss this topical and interesting program on February 11th. \nPlease mark you calendars for this 1.0 hr MCLE general participatory credit for attendees. \n  \n\nInformation about our Speaker\, Devin Burstein:\nMr. Burstein is the recipient of the San Diego Criminal Defense Bar Association’s award for appellate attorney of the year.  Licensed to practice in both California and New York\, his work focuses on criminal defense\, with a particular emphasis on appellate representation. He also maintains a select\, civil-litigation practice\, and is frequently retained by other attorneys seeking assistance with complex appeals and pre-trial motions.  He has amassed a lengthy record of victories in the trial court and on appeal. \nMr. Burstein graduated with honors from NYU\, where he majored in philosophy. He attended the Benjamin N. Cardozo School of Law\, graduating Order of the Coif (top 10% of his class). He began practicing at the global law firm Proskauer Rose LLP.  \nAt Proskauer\, Mr. Burstein focused on white-collar defense and civil litigation. He helped successfully defend a professional sports franchise owner in a major international arbitration and a boxer against an attempt to seize his position as mandatory challenger for the heavyweight championship of the world. In addition\, Mr. Burstein developed expertise in reinsurance – including representing several executives during corporate and government investigations. He also represented (pro bono) juvenile delinquents in appealing their delinquency adjudications\, and was a core member of the legal team seeking a posthumous presidential pardon for Jack Johnson\, the first African-American Heavyweight Champion. \nMr. Burstein left Proskauer to serve as a judicial clerk for the Honorable Judith S. Kaye\, then Chief Judge of the New York Court of Appeals (New York’s highest court). Viewing cases from the Judge’s perspective\, Mr. Burstein gained invaluable insight into the most effective way to present an argument. He helped draft judicial decisions on a diverse array of criminal and civil issues\, giving him an uncommonly broad range of experience. \nWith California calling\, Mr. Burstein moved from New York to join the nationally renowned Federal Defender office in San Diego. He started as a trial attorney\, representing clients in well over a hundred felony cases. He then transferred to the appellate department\, where he continued defending his clients in the Ninth Circuit Court of Appeals. In addition\, he represented indefinite immigration detainees seeking release from custody\, and assisted inmates challenging their convictions through habeas corpus in federal court. \nMr. Burstein left Federal Defenders to form Warren & Burstein.  The firm began with a simple purpose: to bring dedication\, diligence\, and determination to every case.  Mr. Burstein is firmly committed to that purpose. As a result\, his clients benefit from the highest level of representation.  \nMr. Burstein has been recognized by the Legal Aid Society for outstanding legal services\, and has published numerous articles\, including: \n\nSamuel Seabury\, The Judges of the Court of Appeals (Rosenblatt\, ed.)\, Fordham Univ. DESCRIPTION:Our next MCLE lunchtime program will be on Thursday\, January 14\, 2021\, at 12:00 pm\,\nvia Zoom Meeting.\nWe are very pleased to have Klinedinst\, P.C. attorneys\, Irean Zhang and Steven K. Berenson\, as our speakers for this lunchtime event.  \n  \nMs. Zhang and Mr. Berenson will present “Hot Topics in Legal Ethics – Looking Back at 2020 and Forward to 2021” including such topics as:  \n\nDigital Competence and California Rules of Professional Conduct Rule 1.1\, and the ethical implications of being or not being informed about developments relating to legal technology; \nReciprocal referral arrangements vis-à-vis the California Court of Appeal opinion in Jackson v. Legalmatch.com (2020) 42 Cal.App.5th 760\, and its significant impediments on the ability of reciprocal referral organizations to include lawyers in their arrangements\, the ensuing legal drama which followed the decision\, and its implications for the future;\nImpaired Lawyers and the California Bar’s Committee on Professional Responsibility and Conduct (COPRAC) Proposed Formal Opinion 14-0001\, relative to attorneys’ ethical obligations when confronted with an impaired colleague; and \n“Moonlighting” as lawyers move into the “gig economy\,”  and the significant ethical implications attaching to lawyers who perform work for multiple employers.\n\n  \nOur association’s members have benefited from several past ethics presentations given by lawyers from the Klinedinst\, P.C. firm\, and we anticipate that this January ethics presentation will be both excellent and topical. \nThe program will provide attendees 1.0 hr MCLE credit for “ETHICS”.    \n  \n\nInformation about our Speakers\,  Irean L. Zhang and Steven K. Berenson:\n  \nIrean Zhang is an attorney in the San Diego office of Klinedinst PC. Ms. Zhang’s practice focuses on professional liability defense\, especially in the area of legal malpractice. Prior to joining Klinedinst\, Ms. Zhang practiced business litigation\, with an emphasis in real estate litigation. \nMs. Zhang earned her Juris Doctor degree from the University of San Diego School of Law and her Bachelor of Arts from the University of California\, San Diego. In law school\, Ms. Zhang was the Managing Editor of the San Diego Journal of Climate and Energy Law and represented the University of San Diego in international moot court competitions in Hong Kong and Vienna. Ms. Zhang also externed for the Honorable Barbara L. Major and the Honorable Jill L. Burkhardt of the Southern District of California. \nMs. Zhang is a first generation Chinese-American and is fluent in Mandarin Chinese. She is a member of the State Bar of California\, San Diego County Bar Association\, the Federal Bar Association – San Diego Chapter\, the Lawyers Club of San Diego\, and the American Inns of Court\, Louis M. Welsh Chapter. During her free time\, Ms. Zhang enjoys snowboarding\, Pilates\, and hiking the beautiful Pacific coast with her dogs. \n  \n  \nSteven K. Berenson is a Professional Liability attorney with Klinedinst PC. He has represented individuals and government entities in state and federal courts in a wide range of matters such as legal ethics\, civil litigation\, and family law. \nIn addition to his work in private practice\, Mr. Berenson spent two decades as a full-time law professor\, where he focused on family law\, legal ethics\, and veterans’ legal issues. He founded the Thomas Jefferson Veterans Legal Assistance Clinic\, which today provides pro bono legal representation to homeless veterans struggling with substance abuse issues. A prolific writer\, Mr. Berenson has published a textbook on judicial ethics\, as well as two textbooks on family law. He has also written over 25 law review articles on a wide range of subjects. He regularly speaks on a variety of cutting-edge legal topics within the legal and business communities. \nMr. Berenson previously worked as an Assistant Attorney General in the office of the Massachusetts Attorney General. There\, he focused on civil governmental litigation and consumer protection enforcement. He argued cases at every level of both the state and federal court systems and was a counsel of record in numerous reported decisions including those from the Massachusetts Supreme Judicial Court\, the Massachusetts Appeals Court\, and the United States Court of Appeals for the First Circuit. \nMr. Berenson serves as a Pro Tem Judge in the Small Claims and Traffic Divisions of the San Diego Superior Court. He also serves as a volunteer fee dispute arbitrator for both the San Diego County and California Bar Associations’ voluntary fee dispute arbitration programs.  He is a member of the San Diego County Bar Association’s Legal Ethics Committee. \nHe has received both J.D. (magna cum laude) and LL.M. degrees from Harvard Law School\, and a B.A. degree from Franklin and Marshall College. As someone who loves a challenge\, he enjoys hiking\, biking and running. He has completed more than 20 marathons and half-marathons over the past decade. He is also a drummer in a local band\, The Innocent Bystanders. \n  \n

Carr: \nDavid C. Carr\, an attorney in private practice in San Diego\, California\, specializes in ethics advice to lawyers\, California State Bar discipline defense\, and attorney licensing. \nMr. Carr is a 1986 graduate of Loyola Law School in Los Angeles. Following several years of practice in commercial law and business litigation\, Mr. Carr joined the State Bar of California as a staff attorney in 1989\, where he served as a staff attorney\, a discipline prosecutor and a manager in discipline enforcement office before returning to private practice in 2001. He  is a member of the San Diego County Bar Association\, where he is active on the Legal Ethics Committee. He is a member of the Association of Professional Responsibility Lawyers (APRL)\, the ABA Center for Professional Responsibility\, and the Association of Discipline Defense Counsel (ADDC)\, where he served as president from 2008 through 2011.
