We are very pleased to have Devin Burstein\, as our speaker for this lunchtime event.  \n  \nDevin Burstein\, partner at Warren & Burstein\, is our speaker for February\, presenting: “A Glimmer of Hope: Federal Compassionate Release and the Pandemic”. \nIn this presentation Mr. Burstein will address the intersection of the pandemic and federal compassionate release\, providing an overview of the process involved in seeking relief; practice tips; and will discuss what is really going on in federal prisons in terms of COVID-19.  \nMr. Burstein has provided our members with excellent past presentations\, and you will not want to miss this topical and interesting program on February 11th. \nPlease mark you calendars for this 1.0 hr MCLE general participatory credit for attendees. \n  \n\nInformation about our Speaker\, Devin Burstein:\nMr. Burstein is the recipient of the San Diego Criminal Defense Bar Association’s award for appellate attorney of the year.  Licensed to practice in both California and New York\, his work focuses on criminal defense\, with a particular emphasis on appellate representation. He also maintains a select\, civil-litigation practice\, and is frequently retained by other attorneys seeking assistance with complex appeals and pre-trial motions.  He has amassed a lengthy record of victories in the trial court and on appeal. \nMr. Burstein graduated with honors from NYU\, where he majored in philosophy. He attended the Benjamin N. Cardozo School of Law\, graduating Order of the Coif (top 10% of his class). He began practicing at the global law firm Proskauer Rose LLP.  \nAt Proskauer\, Mr. Burstein focused on white-collar defense and civil litigation. He helped successfully defend a professional sports franchise owner in a major international arbitration and a boxer against an attempt to seize his position as mandatory challenger for the heavyweight championship of the world. In addition\, Mr. Burstein developed expertise in reinsurance – including representing several executives during corporate and government investigations. He also represented (pro bono) juvenile delinquents in appealing their delinquency adjudications\, and was a core member of the legal team seeking a posthumous presidential pardon for Jack Johnson\, the first African-American Heavyweight Champion. \nMr. Burstein left Proskauer to serve as a judicial clerk for the Honorable Judith S. Kaye\, then Chief Judge of the New York Court of Appeals (New York’s highest court). Viewing cases from the Judge’s perspective\, Mr. Burstein gained invaluable insight into the most effective way to present an argument. He helped draft judicial decisions on a diverse array of criminal and civil issues\, giving him an uncommonly broad range of experience. \nWith California calling\, Mr. Burstein moved from New York to join the nationally renowned Federal Defender office in San Diego. He started as a trial attorney\, representing clients in well over a hundred felony cases. He then transferred to the appellate department\, where he continued defending his clients in the Ninth Circuit Court of Appeals. In addition\, he represented indefinite immigration detainees seeking release from custody\, and assisted inmates challenging their convictions through habeas corpus in federal court. \nMr. Burstein left Federal Defenders to form Warren & Burstein.  The firm began with a simple purpose: to bring dedication\, diligence\, and determination to every case.  Mr. Burstein is firmly committed to that purpose. As a result\, his clients benefit from the highest level of representation.  \nMr. Burstein has been recognized by the Legal Aid Society for outstanding legal services\, and has published numerous articles\, including: \n\nSamuel Seabury\, The Judges of the Court of Appeals (Rosenblatt\, ed.)\, Fordham Univ. HANSON as this month’s speaker.  Mr. Hanson is a member of our association\, and practices exclusively in the are of consumer law.  \nHis presentation is entitled  “CONSUMER LAW: CAR SALES AND WARRANTY REPAIRS\,” and will draw upon his 20 years experience representing clients in litigation with car dealerships and car warranty providers.   \nThe program will focus on consumer protection laws and the practice of consumer law in these two areas: (1) consumer manipulation and abuse by dealerships during car purchase transactions; and (2) automobile defects and the remedies and limitations of California’s lemon law.  Mr. Hanson will also address how attorneys can assist clients (and themselves) on how to save thousands of dollars and avoid becoming victim to both car sales practices and warranty company “run-arounds.” \nThe program will  provide 1 hour of general  MCLE credit.\n\n \nSome information about our Speaker: \nJohn W. Hanson\, B.A.\, J.D.\, LL.M.\, practices exclusively in the area of consumer law\, with a focus on the lemon law and car dealer fraud. \n Mr. Hanson received  J.D. and B.A. degrees from the University of Iowa\, and an LL.M. from the University of London.  After graduating from law school in 1996\, Mr. Hanson clerked for an Iowa Supreme Court Justice\, and subsequently clerked for the Iowa Federal District Court.  After moving to California\, Mr. Hanson served as law clerk for the Honorable Nita L. Stormes\, Magistrate Judge\, United States District Court for the Southern District of California.   \n Mr. Hanson began his consumer law practice at a firm started by one of “Nader’s Raiders\,” and eventually opened  his own consumer-law practice more than  ten years ago.  In addition to his law practice\,  Mr. Hanson gives presentations on consumer law to public and professional groups\, and he teaches a course on consumer law at Miramar College.

Rosing\n \nHeather L. DESCRIPTION:Our next MCLE lunchtime program will be on Thursday\, May 9\, 2019\, at 12:00 pm at the Manhattan of La Jolla restaurant (7766 Fay Avenue –  within the Empress Hotel).   \nWe are very pleased to have ethics attorney DAVID CAMERON CARR as our speaker for the May lunch meeting.  Mr. Carr will present “NEW RULES ON COMPETENCE AND COMMUNICATION\,” addressing how the rules governing  attorney competence\, diligence and communication have changed with adoption of the new Rules of Professional Conduct;  how the Rules are different from the ABA Model Rules;  and how the State Bar analyzes competence issues from a discipline standpoint\, including application of the “moral turpitude” doctrine to grossly negligent breaches of duty. \nMr. Carr’s prior presentation to our group during 2017 was very informative and well-received.  This upcoming presentation is certain to be worthwhile and of benefit to our members. \nNote: The program on May 9th will provide 1.0 hr CLE credit or the required category of “competence issues.” \n\nInformation about our Speaker\, David C. Carr:\nDavid Cameron Carr\, an attorney in private practice in San Diego\, California\, specializes in discipline defense\, bar admissions\, attorney professional responsibility and ethics advice. \nMr. Carr is a 1986 graduate of Loyola Law School in Los Angeles. Following several years of practice in commercial law and business litigation\, Mr. Carr joined the State Bar of California as a staff attorney in 1989. He served as counsel to the State Bar’s audit and review panel from 1989 to 1992. Mr. Carr served on the National Organization of Bar Counsel’s advisory committee to the American Bar Association’s McKay Commission on discipline enforcement in 1991. \nHe moved from oversight of the discipline system in 1992 to prosecuting cases as a deputy trial counsel in the discipline prosecutor’s office of the State Bar. After five years trying discipline\, admissions and reinstatement cases before the State Bar Court Hearing Department\, Mr. Carr began to specialize in appellate advocacy before the State Bar Court’s Review Department\, resulting in 10 published decisions between 1997 and 2000. \nDuring the shutdown of the State Bar in 1998 after former Gov. Pete Wilson’s veto of the State Bar dues bill\, Mr. Carr worked as an unpaid volunteer in the discipline system. He argued as amicus counsel to the California Supreme Court that a special master be appointed to oversee discipline system spending\, an idea adopted by the Supreme Court in its decision reviving the discipline system (In re Attorney Discipline System (1998) 19 Cal.4th 582.) \nAfter the Supreme Court ordered a special dues assessment\, Mr. Carr became an assistant chief trial counsel and manager of the general trials unit in Los Angeles in 1999. He also worked on discipline policy issues as the chief trial counsel’s liaison with the State Bar’s Committee on Professional Responsibility and Conduct (COPRAC) and the State Bar Court Executive Committee. \nMr. Carr returned to private practice in 2001 and his hometown of San Diego in 2002. He is a member of the San Diego County Bar Association\, where he is active on the Legal Ethics Committee. Mr. Carr is also a member of the Association of Professional Responsibility Lawyers (APRL)\, the ABA Center for Professional Responsibility\, the Association of Discipline Defense Counsel\, where he served as president from 2008 through 2011\, and the State Bar’s Standing Committee on Professional Responsibiity and Conduct (2018-2021). \nMr. Carr grew up in South Bay suburbs of San Diego and attended high school in the small desert community of Borrego Springs. Dullea is Vice President\, Western Region Underwriting Counsel\, Title Resources Guaranty Company\, a member firm of Realogy/TRG (RLGY:NYSE).  \nAfter serving in the US Navy\, Mr. Dullea received a bachelor’s degree in business administration from the University of Arkansas at Little Rock and received his Juris Doctor degree from Thomas Jefferson School of Law (formerly Western States University) in San Diego.  \nMr. Dullea has served as Vice President and National Commercial Underwriting Counsel with another national underwriter. There his responsibilities included handling National and Regional complex title underwriting projects involving Commercial\, Energy\, Home Builder projects. He also served as Counsel for National Default Operation\, the Timeshare Division\, and the National Agency Division.  \nBeginning his career in the title insurance industry in 1971 he has held positions as Southern California Regional Counsel supervising and managing Title and Escrow Claims and Litigation Departments in Southern California; and\, as California Underwriting Counsel engaged in all areas of real estate law including Title Insurance Underwriting\, Escrow\, Lender Transactions\, Foreclosures\, Commercial Projects\, and Common Interest Developments. \nAs a College Instructor\, Mr. Dullea has taught Courses in Real Estate Law\, Real Estate Finance\, Escrow\, Business Law\, and Management and Economics and Legal Research courses at the various colleges and universities including University of Redlands\, UCSD Extension\, and in Community Colleges. He has also taught Online Courses at Southwestern College as a Certified Online Instructor\, as well as in the Classroom. HUNT\, PhD\, Registered Patent Attorney\, and Principal of Plant and Planet Law Firm\, as our March speaker\, presenting: “PATENTING IN THE CANNABIS INDUSTRY – ITS UNIQUE CHALLENGES & OPPORTUNITIES” \nDr. Hunt’s presentation will include discussion of the following: \n1.  The United State’s Patent Office’s hostility toward Cannabis trademarks as opposed to its receptiveness to to Cannabis patents\, and the statutory basis for it; \n2.  Why patenting in the Cannabis industry faces challenges that no other industry has ever faced\, and will for a generation at least\, and what you should tell your clients about it (either as patent applicants\, or as patent-infringement defendants); \n3.  The basics of Cannabis biology\, and why you should know it as both a lawyer and consumer – i.e.\, why THC gets people “high” and CBD “cures everything.” and why the next few cannabinoids will become huge investment opportunities and the related legal implications. \nNote:  The program is anticipated to provide 1.0 hr general credit CLE\, its length might slightly exceed one hour.  \nInformation about our Speaker\, Dale C. Hattam\, General Counsel for the San Diego County Water Authority\, as our speaker for this event. Mr. Hattam will present “Update on San Diego County Water Authority Water Rate Litigation” \n  \nInformation about our speaker: \nMark J. Hattam is General Counsel for the San Diego County Water Authority. \nAs General Counsel\, Mr. Hattam advises the Water Authority’s Board and executive staff on a wide range of legal matters\, including the agency’s high-profile litigation over the legality of rates set by the Metropolitan Water District of Southern California. The Water Authority is the San Diego region’s wholesale water supplier\, providing imported supplies and desalinated seawater to 24 member agencies that serve 3.3 million residents and support a $222 billion economy\, with a focus on securing a safe and reliable water supply for the San Diego region. \nPrior to joining the Water Authority as General Counsel in 2016\,   Mr. Hattam was a 22 year member and partner in the San Diego office of Allen Matkins Leck Gamble Mallory & Natsis\, a California-based law firm with approximately 200 attorneys specializing in real estate\, litigation\, labor\, tax\, land use and business law.   His practice at Allen Matkins involved litigation in state and federal courts regarding water rights\, commercial disputes\, real property\, insurance\, environmental regulations and other issues\, as well as administrative hearing practice. \nMr. Hattam has represented major institutional and public-sector clients in complex civil litigation\, including water transfers and water rates.   He represented the Imperial Irrigation District as trial counsel in 2013\, securing validation of the historic 2003 Colorado River Quantification Settlement Agreement\, a cornerstone of the Water Authority’s long-term water supply diversification strategy.\nIn 2015\, Mr. Hattam served as outside counsel for the Water Authority\, successfully defending the agency against  claim that it failed to account for the environmental impacts of its long-term water supply plan. In addition to being an attorney and certified public accountant\, Mark holds specialty credential as a Personal Financial Specialist (PFS) from the American Institute of Certified Public Accountants (AICPA)\, which grants the PFS credential only to certified public accountants with significant personal financial planning education and experience.  \nEarly in his career\, Mark spent 10 years with a former “Big 8” accounting firm.
